    • Today , after a lot of years i received a letter from this lot. Very friendly, "Were writing to remind you that we haven't had any contact from you in a while".  The velvet fist, followed by  a veiled threat to get their preferred debt collectors involved. Yep dead right. In 1992/3 I took out a Student load under duress from DHSS. up to 2000 I had successfully gotten deferment on low income. But rather than sign on as unemployed ,I decided to be self employed. I applied and they asked for all sorts of documents. I obliged and then correspondence ceased from them, circa 2001. To date I have had no correspondence from Student Loans. I was made redundant in 2009 and reached 65 in 2012 , at which age the loan should have been cancelled. Now , today, 12 years on retirement and 11 ( at least years after last contact) I get a letter with veiled threats. Do I , as I smell a scam a) ignore it and hope that Erudio will think that this phishing attempt has failed or b) respond with a statute barred letter or c) remind them of legal terms that loan should be cancelled 12 years ago or d) combination of b) +c)      
    • But I'm not mixing and matching. Sure, when researching I do check multiple avenues, but when speaking, I will open a single post. The Fb post was made in March, it is now June, time has passed, and when the suggestion was made, no further information was given on how I should progress beyond "send a letter", which has meant that I've needed to start another stream - this one, but only after taking the time to research first.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

Please can somebody explain what I need to do as I am in a situation that is quite worrying.

 

Me and my partner moved into our home just over a year ago. We bought the house off Mr & Mrs H (don't want to mention anybodies names).

 

Until recently we have received junk mail for Mr & Mrs H which is fine. However, since we moved in we have received letters for 5 different names who we don not know and neither do Mr & Mrs H.

 

We started sending the letters back as from past experience, I recognised them to be some kind of payment request. Over the last year, these letters have continued to come on a regular basis and we just kept returning them.

 

The other week, I had finally had enough and began to open the letters to find out what was going on.

 

It turns out they are all debt collection letters that between them amount to around £50,000. In some letters it is stated that the electoral has been checked and these unknown people apparently live at our address.

 

I have been advised not to call the companies as appaeently if I do it is an admission that they live there as I have opened their post - which I know I shouldn't have done but I have been worrying.

 

What has also become apparent both from the letters and our neighbours is that bailiffs have been coming round to our address whilst we are at work.

 

I am terrified as this is not our debt and 5 people appear to be using our address and I'm worried about being blacklisted because of them.

 

Please can somenody advise me what I need to do.

If the bailiffs do turn up while you are in..DO NOT LET THEM IN.. Tell them the facts on the doorstep.

Quite frankly, i'ld get the police and Trading Standards involved quick smart. Get yourself a crime number if you can from the police. Maybe even knock together a simple trespass and harassment warning to hand to anyone who does call.

 

And as previously stated don't let anyone in, possibly have moby to hand as a precaution and start calling the police the second that anyone doesn't leave after being asked to do so.

 

Also, as previously stated, it's an Offence under The Postal Services Act 2000 to open any mail packet that isn't addressed to you, the arguement that it's come through my front doesn't wash.

 

I'ld also be checking all 3 of my credit reports.

 

Hope that helps a little and please don't get worked up anymore.

Thanks everyone for the help and support.

 

I've spoken to my neighbours and they are going to log down if any bailiffs come again and also record if possible - me and my partner are usually as work all day so we haven't seen them. If they come round again I'm going to contact the police.

 

I've also ordered a credit report to see what that has to say.

A notice of disaccosiation at the CRA's and if the baliffs do turn up then co operate - show passport or whatever - I know the onus is on the collector to prove that the debt is owed but it is much more simple to clear it up when they so obvioulsy are not the debtors.
