  2. Hi, I've just begun the process of claiming back my mates bank charges. We requested his charges 45 days ago and today the list has come through. However, it clearly does not list all his charges. He diesn't have statements for the last 6 years but he has some from over the last few years which have clearly been missed off. So... I have a couple of questions. 1) How to we fid out if they have missed other charges off for statements that he does not have. 2) They have said we can request all the statements but this will take longer. After waiting 45 days already we are both getting inpatient now and I don't think it is right that we have to wait longer for something that they should have already provided to him. 3) Have they breached any laws by not sending a full list of charges. 4) I sent the standard letter asking for the charges which does not mention anything about actually making a claim. However, in the letter they've sent to him it mentions several time about him claiming his bank charges back. Is this normal? Thanks L x
  3. Thanks everyone for the help and support. I've spoken to my neighbours and they are going to log down if any bailiffs come again and also record if possible - me and my partner are usually as work all day so we haven't seen them. If they come round again I'm going to contact the police. I've also ordered a credit report to see what that has to say. Once again a big thank you to all. x
  4. Hi, Please can somebody explain what I need to do as I am in a situation that is quite worrying. Me and my partner moved into our home just over a year ago. We bought the house off Mr & Mrs H (don't want to mention anybodies names). Until recently we have received junk mail for Mr & Mrs H which is fine. However, since we moved in we have received letters for 5 different names who we don not know and neither do Mr & Mrs H. We started sending the letters back as from past experience, I recognised them to be some kind of payment request. Over the last year, these letters have continued to come on a regular basis and we just kept returning them. The other week, I had finally had enough and began to open the letters to find out what was going on. It turns out they are all debt collection letters that between them amount to around £50,000. In some letters it is stated that the electoral has been checked and these unknown people apparently live at our address. I have been advised not to call the companies as appaeently if I do it is an admission that they live there as I have opened their post - which I know I shouldn't have done but I have been worrying. What has also become apparent both from the letters and our neighbours is that bailiffs have been coming round to our address whilst we are at work. I am terrified as this is not our debt and 5 people appear to be using our address and I'm worried about being blacklisted because of them. Please can somenody advise me what I need to do.   6. Hi, Is there anywhere I can find a a standard defence from Cobetts. I'm a little bit worried about the defence they have sent as I don't understand anything it says and I've just seen the defence that my friend has received from another bank and it looks completely different to mine.   7. Hi, Quick update. Natwest filed their defence and I have just received the allocation questionaaire through from the courts which I need to fill out. I have two queries where people I know have been giving me advise and I'm not entirely sure what I need to do. Query 1) in the defence it states 'On allocation the Defendant invites the court to direct that there be a case management conference in order for the court to consider the making of appropriate orders to give the Claimant the opportunity to properly partuculise the claim'. Does this mean the court can ask me to get evidence of my particulars. The particulars I put in were from this website so I though it would all be ok. Has anyone had this statement in the defence. Query 2) My brother has just won a case with Yorkshire Bank. He has advised me to add a proposed directions sheet into my allocation questionnaire and sent me some info to put in. Is this the norm?   8. Thanks Fendyweather. Will keep you updated when I get the details through from the courts. I've got the bug now! I've decided I'm going to chase all my ex accounts now. I had a credit card with Natwest but I don't have any details or statements from it. Does anybody know how I can find these out. I know when I first started with my current account with Natwest they told me a load of rubbish about how they don't keep any records - yeah alright!!! Any ideas about how to get hold of my credit card details? Thanks L x

  10. Hi, I'm about to start claiming against Egg but I need to get my statements from them. I haven't used my Egg account for years and I do not remember any of my login details. When I called them to get my account number, they wouldn't give it to me as I couldn't remember my password or security number. Already, I've hit a extremely big wall!!! Can anybody advise if: a) They know of any sample letters when you don't have any account details b) If they are also claiming against Egg and how they have found them so far. Thanks L x
  11. Thanks for all your help and advice everyone. Nervous but quite excited about it all. I can't get over how good and supportive this site is. I read through my defence from Cobbetts last night. It looked pretty standard although I didn't understand any of their defence - i expect it was all as it should be though. I think I'm just waiting to hear from the courts now and we'll take it from there...
  12. Hi, I issued against Natwest after they rudely ignored my letters requesting they pay me back. As soon as I issued they they filed a defence. I;m quite scared now as I don't want to do anything wrong. Is there anyway that's had to go all the way to court and face Natwest - don't think I have the guts to do it. Do I just wait for the courts to send out my allocation questionnaire now they have filed their defence? Oh dear God!!!
  13. Hi, I am about to start claiming charges back for a friend and I am a bit confused about how far you can actually go back. I thought it was only 6 years but other people have said it's more. What is the maximum you can claim back for? Thanks
  14. Oh well, thanks for your help. The only thing I'm worried about is not getting the claim in before this new ruling passes through with regards to the maximum the banks have to pay back per charge. It's all so stressful!!!
  15. Hi. If anyone could help I would be really grateful. I am currently at the stage of taking Abbey to court but I did not realise that you had to pay a fee between £30 and £120 at the beginning. Does anybody know if there is any way around this. Unfortunaltely, I do not have the spare money to do that at the moment and do not want prolong the claim any further. Thanks
