Hi yeh, i did put it forward to the sheriff officers and they put it forward to the banks - i am going to call them today (banks) and give them one last warning - i was not sure because of this new hold rule! ?! It has been well over 2 weeks and nothing. What's an attachment? thanks.

The sheriff has already passed judgement on this. They have no option but to pay.

 

What's an attachment?

In this case it will be the seizure of goods (which usually focuses the banks mind) and if necessary the subsequent sale of them.

Try to talk to the legal dept if you can get the number. Tell them you will be requesting an attachment (they'll know what that means) if you do not have your money in your account in say 24 hrs. If they do not pay then just go back to the Sheriff's Office, that served the extract for Payment and they will sort out the rest.

 

As Rory says the banks will become very focused once a Sheriff's Officer starts making out attachments for equipment in the branch. They will have another 14 days to pay but once that has elpased the Sheriff's Officer will go back and start removing equipment which could in effect shut the branch down or at the very least cause them a lot of problems!

 

I also had two banks ignore payment orders but after a few phone calls Lloyds have now paid up and Abbey have said they will pay this afternoon! Don't forget you get interest for every day they are late:)

Thanks guys, thought after all this test case was going on all my work was for nothing - contacted the bank who advised that they have not received it - what a bunch of jokers!! I am going to write them one final letter - if they don't respond then i am going to get the attachment - just went to the officer now - its handy as its near my work ))

You have not said which bank it is, of course they recieved it you have proof as the SO would have sent you a letter telling you where/when/how it was served. I would just phone the bank back say you have 24 hrs to pay me £xxxx else I'm going back to the SO.

I agree with maryhillgull. If you give them forever and a day then that's how long they will take to pay. If you want paid quickly you need to start asserting your rights (they wouldn't be so understanding if the shoe was on the other foot).

The bankk got back to me today - they said that the legal dept are taking care of this and they are sending out a holding letter that i did not sign when they offered me the first offer in the first place towhich i did not received - what do i do now - put the attachment forward?

Things seem to be slowing down for us in my house as we are just waiting for the banks to go to court and then hopefully we might be able to get on with our claim with the FOS.

I don't know whether in January when the summary clause amount goes up to £5,000 if we will maybe try court again for my son's £5,000 in bank charges. We will wait and see.

You seem to be having so much bother with your claim I am surprised that you are still hanging in there.

I wonder if somewhere at the bank they have totally messed up your account and that is why you are having so much trouble. If the sheriff officers have to go into the bank please, please let us know and I will definately come and cheer you on. You can't miss me I drive a lovely big hackney taxi.

By the time that you finally get your money you might be able to pay my fare. Ha Ha.

Hi Eileen, hope all is well, if the summary clause is going up in jan then may as well wait hey.... i put in the attachment on the 27th sept so lets see what happens Planning to go away on holiday with that money too!!!!

Not heard anything back so far nut due to postal strikes looks like it may be next week til i get a letter or summat. Will let you know when this happens as i would need help..... think i may need to shut my aco****s with them too!!!! Pay ur fare? lol hey ur the cabbie.... i will expect a free lift
