      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just keep going. This letter is meant to intimidate you and think you are lucky to get any money at all. Without being able to post your thoughts on this forum is it feasible that you would have accepted? This is how they operate. Within the next 6 weeks you will have all your money and the 8%. Don't forget the £10 will you..............

Hi, when they 'pay up' will this include my court fee? And is the court fee payable on the day you submit your claim form?

 

I'm going to take my claim form (3 copies) to my local county court tomorrow, the 14 days expires tomorrow.

 

Do you know what I should do about the Halifax offer? should I call them to let them know I am not accepting it?

When they pay, you will get your court fees, court costs, and charges.

 

You could send the rejection letter stating you have started court proceedins.

I also have a cap 1 claim, they have failed to reply to my LBA (expires tomorrow), should I file my court papers for that tomorrow also? I read a few threads and it seems that capital 1 responded to most peoples LBA's so why not mine?!!!

Like all banks and cretit agencies, they dont always follow the same pattern.

 

If your Lba runs out, then yes you can file this aswell.

One final question, does my value section look ok to you?

 

Charges £411.00

Interest under s.69 County Courts Act 1984 £124.23

Court Fee £80.00

Claimants cost for obtaining statements to determine charges £10.00

 

Plus interest pursuant to S.69 County Courts Act 1984 from date of issue to date of judgement/settlement at £0.11 per day - (CHARGES £411.00) + (INTEREST £124.23) x 0.00022 = £0.11 per day)] OR at such rate and for such periods as the court deems just.

 

I had an overdraft at the time and I struggled with working out the interest for overdraft as a result of the charges but I'm fine with just claiming £534.23 plus statement charge.

 

Thanks for all your help, couldn't have got this far without the help of the people on the forum, I'll be sure to donate once I receive my money!!

If you had an overdraft then you add the interest to your charged for your daily interest. So it works out at 24p a day.

Apart from that it is fine.

RESULT...

 

I was all ready to submit my N1 yesterday but before I took it to court at lunch time I decided to call and give H'fax one more chance, I called Hugh Jones (customer relations manager) and left a message for him to call me before lunch, didn't think he would but he did abount an hour later. He offered me £300 of the £411.00 I was claiming, I refused. He then asked me what I thought was a fair charge, I stated that £2.50 was fair but as they were unwilling to reveal their actual costs, I said I would still be claiming it all back. He agreed and stated that he would be sending me a letter in the post for me to sign and return. I asked for the £10 for statement charges which he refused to add but I was so happy that I had won that I wsn't really that bothered!!

Discovered 2 further a/cs, and 3 Loan accounts. "Goodwill offer" of £7,424.23 06/07/07. Accepted (partial repayment). 20/07/07 Top-up payments of £2,558.10 & £1,154.00

£11,136.33 paid back thus far.

New claim issued: 9/07/2007 for 3rd account: £500+ PRESSING ON!
