      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

lol, Donny said he was almost 50... looks good and loads of energy. Yes, good show even if you had to pay.. My front row seat was brill, but all the women were trying to get to the front and the security guards were saying if you have a front row seat you can stand at the front, well, I was then counting how many were standing against the empty seats... lol my friend said you will get lynched in a minute! Crazy Horses was good

nah, not the full set of osmonds, but donnys band were good, fab sax. The osmonds are going to do a tour soon.... but how old will be oldest be! does not bear thinking about. kept my underwear on as well

you wouldn't have kept them on if it was Tom Jones I suppose jenny;) well you lot never fail to give me a good laugh, tell me again where do you get these pictures from, I've fogotten and I think I should learn something new now:D

Poor old soul, hes still up the scaffolding,( NO not this minute tez!) did I tell you he found a long section of barge board and fascia board had rotted, thats what delayed him, had to make all new huge amount of extra work, and tomorrow he's going to hospital to have his cataract operation, so he can't do anything for at least two weeks, house looks lovely with scaffolding across the front !!!!

WHERE DID IT ALL GO??:eek: I thought it was me at first, what happened? I was waiting for a letter from the Judge, which might help or claim, as he told us, and I received a "Notice of Judgement Hearing" today. I don't understand whats this all about? heres what it says:-

 

Take notice that the hearing will take place on 30 October 2007 at 10.40 AM at Cardiff CC .....

NO ATTENDANCE REQUIRED

5 minutes has been allowed for the hearing

please note.. This case may be released to another Judge, possibly at a different Court.

warmed up now tezl, was so cold mon/tues.... I wonder if the clue to the 5 min court thing is in the heading... Notice of Judgement Hearing... but dont understand as he made his judgement at the stay one...will give court a ring on monday!

my mum had that op when she was 75,12 years ago she was told not to do anything for 6 weeks especially bending.

vals oh has been told a couple of days.things progessing i suppose.

bet vals letting him off with only bringing her breakfast in bed instead of 3 meals a day.lol

HI Val, glad to hear hubby recovering and its only boredom that is giving him grief...but im sure he will see (excuse the pun) benefit in a few days or so.

whats going on on MSE .. not usually so busy, especially as this site seems rather quiet.... something we said lol
