I wrote to Barclays on 31.05.06 requesting details of bank charges on my current and business account. I received some information dated 6.06.06 but it appears the info is incomplete as the detailed statement info dries up from 2003 to present. I rang today and spoke to Brian Winbow who has said he will provide the info on my current account but I have to ring again to obtain details on my business account. Should I send a follow up letter reminding them they have less than 40 days to comply? Also on my statements it refers to 'unpaids out' which I took to being a bank charge but it also shows 'paid referral', is this another type of bank charge. The business account charges are a little confusing as I do not know what I should be claiming back? eg: auto entries, standard entries, maintenance fee, a/c control fee, commission????

 

Any help and advice would be appreciated.

Hi There,

 

I am pretty sure that the 'Paid Referal Fee' that you mentioned is a bank charge, as they seem to appear on our statements frequently, and usually for £25 / £30 a go !!

 

These are what we are claiming for !!

Just received a 10 point defence from barclays and am about to fill in the allocation questionaire.... just need a little help with 'Section G - Other Information', what do I write in here? I have looked around the site all day and have not found any info as to what to write. Obviously as Barclays have submitted a 10 point defence I wanted something substantial and hard hitting to write in this paragraph...... any ideas???? :confused:

If you look at Bookworm's thread you could put the paragraph below in - if the judge goes for it, it means Barclays will have to disclose how they make up their charges. That should worry them - this is exactly what they are frightened of. There is no way they can justify the amounts they have been charging and if they were forced to explain in court, it could be very damaging for them.

hi all,

I didnt ask for 6 years statements, just calculated from the time we had been back in this country. which is 2 years. But did say if they disputed I would require details of charges for last 6 years. I have received the goodwill gesture of 50% of my claim. I came back on to look at the templates that were available but cannot find them. can anyone direct me please.

Bookworms paragraph is enough. Section G is for directions about your case NOT particulars of your claim. It is if you need a translator, wheelchair access, you are deaf and need a signer , that sort of thing.

Thanks, I sent the AQ yesterday and I included copy of schedule of charges and the various correspondence between myself and the bank..... I know I didn't have to do that but I just thought if I had filed in person at the courts then they would have all that info anyway and i didn't think it could any harm..... you're gonna tell me now I shouldn't have done that aren't you????:confused:

When the court has received the AQ's from both sides, then a judge will decide what to do with the case, ie which track to allocate it to, and set a hearing date.

 

There isn't really a set timescale; it all depends on the court and how busy they are. I sent my AQ to the court on 11th August, Barclays filed their's on 5th September (just a little out of time, as they are supposed to file within 14 days), and I received notice from the court yesterday that the hearing will be on 20th December

After refusing the 50% goodwill offer from barclays they refused to go any further. I requested the 6 yrs breakdown of charges. they have sent them as statements in a format so illegable i'm sure they do it to put you off. I will not be put off!! So highlighting pen is fully loaded and ready to go. Once I have redone my spreed sheet I will apply to the courts and let you all know.

Unfortunately, no..... I am in St Helens, Merseyside.

 

You know on the court form and it says to bring with you copies of all documents (including any experts' report) on which he intends to relay at the the hearing..... what documents have you sent???

 

Is it just copies of prelim, lba, schedule of charges etc or should I bring anything else.....?? I would appreciate any advice!!

Thank you.... I will have a good read of jonni2bad thread, just got myself into a panic as I don't want to let myself down by appearing stupid and not having the right documents.... should I write out some sort of statement, I have until 30.10.06 to return documents to all parties...

Jonni's is aiming at a default removal, and a lot of it is irrelevant to your claim. Stick to the one I have made up in the Library, and make sure you read the post I've made that accompanies it!

Thanks for that Bookworm, I was feeling a little overwhelmed, it's been a long time since I had to do any form of revision and although I am reading and reading everything, it just doesn't seem to be sinking in.....!!

 

One more question, the documents I include do I have to photo copy 6 years worth of bank statements and include these as well???

Will this do ??? and when do you think I should send it.... (it needs to be in by 30.10.06, should i leave it till the last minute in the hope that they will settle before the date or send it straight away???

 

Also have read an interesting article on Financial News, City News, Mortgages, Loans, Savings, Pensions, Market Reports | This is Money by the Daily Mail Finance Editor, calling for magistrates to reprimand banks for wasting court time... the article is entitled Endowment Anguish goes on if anyone wants to read it.....
