    • Worth noting that all of these firms - either the alleged EIS investment, the rebate company themselves or the payee were all registered to the same address. Clavering House is 3 miles away from HMRC Benton Park view offices.   Wardrop - unfortunately unsuccessful due to late appeal - assessments opened by HMRC in March 2019. Scammed by Richard Hall (Capital allowances consultants ltd - Clavering House) investments into Cryoblast Limited 15/16 (Paul Huggins - Clavering House) and Eco Cooling solutions 16/17 (Anthony Fitches - Clavering House).    Mccuminsky - scammed by Capital Allowances after providing his details to Stefan Brown Alpha Tax Consultants (Clavering House) payment made to Eco Cooling Solutions.    Robson - scammed by Capital Allowances - 15/16 paid to Cryoblast 16/17 paid to Eco Cooling.    Myself - scammed by Allan Maxwell - MaxTax (other business Maxwell electronics) registered to Clavering House.   Cryoblast Solutions and Fast Tax - Alan O’Hara    Please note there are two Cryoblasts involved - Cryoblast limited (Paul Huggins and Clavering House) and Cryoblast Solutions Limited (Alan O’Hara also director of Fast Tax).    My return simply said “Cryoblast” another thing that should have been clarified as part of HMRC guidelines before paying out the claim.    Cryoblast limited was already suspected to be involved in fraudulent claims before my investment as Huntly had open assessments issued in November 2018.    Cryoblast Solutions, the same company director as Fast Tax where my money was sent was dissolved before my claims were submitted.

    • I am reading the thread now and think although its probably very similar to my predicament,  I have no way of obtaining the terms anymore due to MyParcelDelivery having being dissolved and their website not being active now. I have nothing to quote from and they didn't send me a copy at the time of order, the website that I believe they reinvented themselves as P4D has terms I am looking at now but however similar they may be I wont be able to quote from them in this case. Thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi, thnx for the guidance to the site guys.

 

using m,s,expert i sent in for my last 6 years of bank charges, studdied all of the bank charges incurred from them over that period. the total came to over £2,900 exc statutory interest at 8% giving a figure of £3,572.43.

 

i then used msexpert's first initial letter demanding that they repay this back to me. barclays sent me a response to my letter dated 23/03/07 after a couple of weeks with their standard bumf leaflet please allow 4-8 weeks etc. i was not happy about this, as i saw it as a stalling method by them. i then joined this site as i like how much more legaly threatening the template letters are.

 

i then used the initial request template letter and modified it a bit into the l.b.a one, as i thought it of no use sending the same type letter twice again allong with a copy of the charges. i made sure i outlined that i was to receive a positive response to this letter within 14 days.

on the 13th day barclays sent me a denial letter stating that their charges are fair in accordance to the t&c that i agreed to.

but in the same they are offering in full and final settlement to this claim, £2,200. :razz: sign and return within ten days etc.

 

my overdraft stands at £2,235? which is a bit strange i thought. i think they are looking to balance my account then p**ss me of by closing it, not a problem as i have my parachute account with my bulk already in it:rolleyes: .

 

as the actual charges amount to £2,935 (my calculation before the 8%) £735 short, do you think i should contact them demanding the rest, at least £2,935 worth or skrew em all the way by issuing a county court claim for the full amount?:)

If you dont accept they'll withdraw their offer anyway, send them a rejection letter from the templates library and proceed to mcol when the 14 days are up :)

but the letter has no header of refrence.

currently i am in waiting for a substantial inheritance to clear in 3/4 months, and as usual (for the last 25 years or so), i am skint at the moment and my tactics are of a fighter so no worries there but, i dont like loosing what was mine either?.

sounds like the standard letter they send everyone, they just change the name and amount! Stick to your guns dogtoy and get back whats yours :)

so wotz u actually saying?.

my lba deadline date ran out on 01/06/07 and bc's are offering me £2.2k,as @ 30/05/07.

do i send a letter accepting it as partial payment to my claim only.

then continue with a mcol? (dont know whot this means yet lol) asap.(now)

or do i call them and ask for the full amount or else?

one more thing i have just noticed on the guidance. i have from the outset made a claim for the full amount plus 8% interest. yet it states - Enclose a schedule detailing the charges you are claiming, but do NOT include the 8% interest on the schedule yet. will this affect my point to barclays charges i require back from them and /or court claim as being unreasonable request as it has not yet been summoned to the court. ie who am i saying what interest i should charge?

Hi Dog, I see you got two good advisers helping you out.. lucky you!

 

as to claimimg back the interest from the start, IS incorrect but doesnt cause any issues, i did the same on my claim and I had no problems whatsoever on that side..

which ever path you choose to go down whether MCOL or N1 remember to have your updated SOC's ready to file with it.

You need to send/give both parties a copy, [incl interest]

 

Remember any questions post here first before doing anything so someone can check youre ok

Response to settlement offer.

 

Dear James Scott,

 

Thank you for your letter dated 30/05/07. I respectfully decline your offer of £2,200 which is well below my initial claim of actual charges amounting to £2,935 for the period (excluding 8% statutory interest which a court will award to this case total £3,572. 43) in ‘Full and Final settlement’.

As set out to you in my recent correspondence, my ‘full settlement deadline’ being 01/06/07, has now expired. Therefore, as you have failed to settle this matter to my rightful satisfaction, I shall be commencing county court proceedings against you/Barclays bank at my first instance in regards to the unlawful charges your bank has imposed and taken from my/our account.

as a gesture of good-will, you may contact me at your immediate first instance (within the next couple of days only) with an offer in full, to the above initial figure of £2,935 as claimed, (without conditions) and I shall without prejudice prepared to waiver any interest charges due that I can rightfully claim, providing this offer is made prior to commencing court action with intent to proceed, otherwise further cost’s will be encountered and claimed from you including updated interest charges relating to this claim up to the time of the court hearing date.

 

I trust this clarifies my position.
