Hi,

 

having loads of advice off here off some lovely people,i am doing claims for myself, my dad and now my brother has asked me!! i will start comission i think!

 

I would like to know if the debt is over 6 years now can you still claim back? do you have to have the details? if he dont have the details but know the companies is he still able to claim? would it show on my bros credit file or would it be gone now or is he better off leaving it

 

he has some debt from awhile majority of the amounts are due to charges so if he was to claim it back and they took it off what he owes how does he pay the bal then can he do a agreement i.e instalments?

 

sorry for all the questions but i just hope i can sort this out for him as he has struggled for years he helped me when i had a bad patch so just want to return the favour

3 Nov: statements arrived. Charges calulated at:

A/c 1 - £2,178.01 + int of £1,206.54 (18.4% authorised)

A/c 2 - £206.11 + int of £211.07 (18.4%)

7 Nov - prelim.

3 Dec - LBA

13 Dec - £750 offered

23 Dec - £750 credited

28 Dec - rejection letter

2 March - issued

16 April - complained at court failure to forward defence

 

Halifax

 

22nd September: Subject Access Request.

4th November: No reply so LBA giving 7 days.

 

Cap One

 

22nd September: Subject Access Req.

5th October: Letter saying no record of account!

15th October: Replied telling them to try harder...

22nd October: Subject Access Req acknowledged.

thanks.....i was just reading some similar threads with yr messages on !! how mad is that ...lol

 

i am just wondering if he hasnt had contact and they are about to go over the 6 year mark if he makes contact now it will reset the clock wont it??
