    • An update - Still receiving emails and letters - but have been getting text messages too. nothing aggressive just asking me to get in touch.    the text makes it look like it from the bank on first glance - it reads -   'the banks name' would like to dicuss our recent communication...etc... then lists IDR phone number and email FYI - reporting them as spam
    • Hello, After seeing all of the posts about BMW on here I really wish I hadn't even considered them! I bought a used car from them over the weekend, one specifically which had a reversing camera and cruise control in the advert. I was foolish at the time of purchase and didn't check to see these functions work on the test drive (totally my fault). Now that the car is home I've checked and checked and neither of these functions are available. I even checked on Parkers and it seems that no Skoda Kamiq '21 models come with any parking cameras at all. When buying the car, I was told all that was needed was 'Four signatures and £500' to secure it. I was never shown any of the documents, and instead the sales rep opened a box on his iPad and asked me to sign. He had been complaining about the length of time some customers take these days all throughout my time with him. (Again) foolishly I signed. In my email inbox I now have four attachments from BMW, one of which is my signature under a letter which basically says that the cars don't need to match the advertisements online, or have any of the features that a sales rep talks about. I realise that I've made mistakes in not doing my due diligence here, but thought I might as well ask the experts here if I have any rights left to claim that the car was miss-advertised, or if I unknowingly signed them away? Thanks in advance

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I will buy a virtual pint for anyone who produces a properly executed agreement from MBNA. Reckon I'll be able to get virtually drunk sooner or later.

I haven't read the link, but it crossed my mind that MBNA don't actually execute agreements in airports or at football matches - they ask people to apply. As we all know, they don't process these application forms properly and try to pass them off as agreements.

 

I wouldn't have thought this sales technique was any different to when you see people in the street canvassing for catalogues, phone companies etc???

Ok, It is past the date Carters said they would issue a court claim so I have sent MBNA the following letter CCd to Arrow, Carter and Callcredit (as only Callcredit are still publishing a default placed with them by MBNA/Arrow)

Furthermore, I am pleased to advise that we will be removing the adverse information from your credit file, dating back to May 2007; please note that this may take up to 28 days to update with the Credit Reference Agencies.”

I have today audited the files held by Callcredit in respect of the above numbered account and find the following information published by your company and Arrow:-

It now long past the date which you said this erroneous and damaging data would be removed.

 

The publication of this information is causing considerable damage to my reputation and creditworthiness.

 

Since our last correspondence, I have been pursued and harassed by Fredrikson International, Arrow Global LLC and, finally, a firm of solicitors called Bryan Carter & Co all whom have been attempting to collect money from me using Account Number XXXX XXX XXXX XXXX as their reference. Indeed, Bryan Carter & Co insist they will be issuing Court proceedings against me in connection with this account on behalf of Arrow Global LLC

 

You have 7 days to rectify you error. Failure to do so will mean I will immediately begin a County Court claim for libel damages naming Arrow and Callcredit as co-defendants without further notice. Once any such action is started, it will be seen through to its conclusion.

Had a reply dated 19/06/08

 

Dear Alphageek,

 

I am sorry that on review of your credit file held with Call Credit that you have found a default to be registered against the above account. We have contacted Call Credit today and they have confirmed that there is no such entry recorded on your credit file; therefore confirming that we have honoured the actions confirmed to you previously.

They claim 179.00, court fee of 15.00 and solicitor's costs of 50.00

Yes, I had read a few times on here about Carter splitting the claim and that being against some rules.

 

Let's see: MBNA thought I owed them 1797.02. Let's same MBNA try to offload their unenforceable debts at 10% of the balance. Arrow/Carter are trying to claim 179 from me. Looks like MBNA won't give Arrow their money back LOL

 

Or they're just trying to get an extra pay day.
