      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Received a letter from my local court this morning.

 

The defendant files an acknowledgement of service on 19th July 2007

The defendant responded to the claim indicating an intention to defend all of the claim.

The defendant has 28 days from the date of service of the claim form with particulars of claim, or of the particulars of claim, to file a defence.

 

The acknowledgement was filed by the solicitors acting for the defendant who have given the following name and address for service of documents

 

HBOS PLC

Legal services - retail division

Halifax

West Yorks

HX1 2RG

 

I now need to search and see that the hell this means as it's a different letter to my bank account :D

 

Having gone through all my paperwork today - I have noticed that this court claim is for my statements - no wonder they are defending, I've had them ages, it might also be the reason I have now had 2 lots! I did write to the court to say this claim was settled. I will sort it out Monday when I file my N1 :o

 

So back to where I am now - My LBA is up tomorrow, I will give them a call and ask if they want to give me my money back, if not I will file at court.

If I get to file at court I am claiming contactual interest on this and my Barclaycard - I feel if they have charged me high interest, then I shall charge them too. :D

Onwards and upwards.....

Got a letter from Halifax Visa this morning.

 

Thank you for your communication regarding your account and I regret that you have found cause for complaint...

 

Blah blah blah blah

 

I am prepared to offer you a refund of charges to the value of £xxxx which represents half the charges applied to your account over the past 6 years.

 

If I don't hear from you in the next 8 weeks i will assume you are happy.

 

They enclosed a full and final settlement letter for me to sign and send back.

 

Dream on Halifax - I'll see you in court. :lol:

I don't get why they offered half though - I mean Barclaycard offered me the difference between the £30 and the £12 the OFT said was "fair".

 

Well - Halifax have now shot them selfs in the foot - I will now do my N1 with CI added - anyone know what rate we are charging them??

I,m a silly Billy.

 

I have just got my wifes statements from Barclaycard Visa. I was going to issue LBA. I did 8%, so I take it I should change to CI. That will make a huge difference-

 

As MacBoy would say- Kerchiiingg!!!!!!!!

 

Can you please point me in right direction for a SI spreadsheet and I will redo my calculations, sorry my wifes, today!!

 

From memory, the charges over 6 years were £900.

Can anyone help?

 

I am trying to find out what interest rate to charge Halifax Visa - on my statements I have:

 

Balance Transfers: 22.53%

 

Purchases: 22.53%

 

Cash 23.95%

 

Cheques: 23.95%

 

As I have all these items on my account, what rate do I use for Contractual Interest?

 

At the top of my statements it says: TYPICAL 22.5% APR (Variable) is this what I use?

 

Help would be appreciated. ta.
