      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

Got a letter from Financial ombudsman this morning, seems they have written to Click Finance, who were the brokers that sold me the secured loan and PPI, they have advised them that they have to deal with the matter. I telephoned them and asked to speak to a manager, got told they were all in meetings and would call me back! you guessed it, NO CALL.

Blemain have now said that they will give me a full refund of my PPI if Click finance tell them that it was miss sold.

I am still going round in circles, because now Click will not respond to my calls or emails etc.

Seems I now have to give Click Finance 9 weeks to respond.

This all takes the biscuit ! I am feeling pretty down with it all, it is costing me a packet in letters and phone calls.

 

Has any one had any luck with getting their money back with Blemain or brokers yet?

 

I do not understand why the broker put us with Blemain in the first place, not knowing we just took their advice. But we had NO CCJ's or defaults or anything. Never missed a mortgage payment, in fact we have perfect credit rateings, it was just that we are self employed. No HP, No credit cards nothing. Just a very large house with a lot of equity.

Which saying that makes me now begin to wonder, is that what these firms are after!

Is it the FOS that have stated Click have 9weeks to deal with or Click?

 

I would give Click a couple more days and then phone the FOS and tell them you are bieng ignored.

 

Don't think there's much point talking to BF they won't do anything, I've been trying to get them to deal with my complaint since March and they just keep ignoring me!!! They are bloody useless.

Hi,

It was the Financial ombudsman that have said that I have to give Click for Freedom finance 9 weeks to respond.

I have just come off of the phone to them, even though it took me all afternoon to get to speak to a manager. Anyway, he has promised to get to the bottom of it and is going to call me back tomorrow afternoon. He said he is not happy about the fact that his department have failed also in that they never responded to my emails or rang me back.

So I am hopeing that it will be sorted asap, but I will not hold my breath!!:wink:

 

I told him that I have found others with grievences about Blemain and he was shocked, he was also not aware that they were not registerd with any one and had onlky recently registerd with the FISA or what ever they are called.

I have no reason to doubt the bloke as he seemed a very genuine type of person, especialy whebn I told him my daughter in law is a solicitor and that she has looked at the agreement with Blemain and found fault with it.

He seemed to agree with most things which I complained about.

 

Anyway will have to wait now and see what tomorrow brings.

 

It is raining buckets here and I have a thumping head, thanks to Blemain and Click, p'haps I should send them a bill now for my painkillers!! LOL :grin:

 

It is nice to know you are not alone in these matters as at times it makes you feel like throwing in the towel and letting them win, but then you have to stop and tell yourself that if we all did that these rogue companies would be laughing all the way to the bank :mad:

 

Not my week this week, hubby damaged my car accidently when reversing so haveing to wait for my motor insurance company now. Yet another problem for me to deal with. Daughter getting married, posh do, next March so busy now with that, . Also fighting home insurance company for pay out on mains water leak damage to our drive, getting run around from Norwich union over that. Problem is you only ever get through to a call centre in India. They never seem to know what you are talking about and ask for same info over and over. So had to phone London office this morning to sort that out.

Defenaetly NOT my week. I need a long hot sunny holiday now to recharge my batterys.:grin:

Im very close to the Devon border and it's been pelying down all day here with thunder and lightening.

 

You are having a bad week but as they say things can only get better:) .

 

At some point could you possibly say a bit more about what your daughter said about the agreement as this could be really helpful to the rest of us battling with BF.

 

Chin up and lets hope Click respond quickly but beware BF will not be so quick!

My daughter states that there is no where in the agreement that says anything about early redemption charges, in fact there is no information about redeeming the account any where in the agreement. It should have a section some where, which states what you would be charged if you redeemed your account, eg, within first 3 years X amount, after 3 years X amount, if you know what I mean. You normally find it on most agreements and mortgages, but ours had nothing at all.

 

Hope that helps and makes sence.

 

You will also probably not find any reference to removeing the charge on your property either. BAD :mad: W e did get ours removed but only after a fight.

 

We also found that we never got anything back from BF to say we had actually repayed all of the loan, at least we have our bank statements etc to prove it. We requested a letter of confirmation but that never came.

thanks for that. I will check out what mine says about the charging order. Mine does have info about the early repayments but doesn't make sense to me.

 

I have had loans with them before and I never got any final paperwork when they were redeemed but I am awaiting their reply to my SAR so we shall see.

 

We've got sunshine now here, typical when I have sign on for work now:(

Hi all

got a bit of news for you, its the broker you go for, first check to see if they are registered with FSA, then if they are write to them with your complaint, its they who sold you your loan, PPI etc, they were paid a fee and its the Broker who is supposed to MAKE SURE that what they are selling you is THE BEST DEAL FOR YOU, as regarding PPI in many cases when you are self employed there are clauses which will prevent you from claiming and the broker MUST be sure that the policy they are selling you IS SUITABLE FOR YOU, they MUST TALK YOU THROUGH THE PRODUCT THEY ARE SELLING YOU so that THEY AND YOU ARE COMPLETELY SATISFIED THAT YOU ARE AWARE OF WHAT YOU ARE BUYING or ENTERING INTO before you sign anything, THEY MUST GIVE YOU A 14 DAY COOLING OF PERIOD AND NOT CONTACT YOU IN THAT TIME, i only had a short conversation with him but thats the jist of it, il find out more tomorrow, also i put into google 'complaints against blemein finance'

and they blogged all the complaints so if you have a google account you can access them...GC

Forgot to add

this guy sells insurance and also arranges mortgages, he said he always pays home visits to make sure the customer is completley aware of what they are buying and there is a form the customer must sign to confirm that the policy, loan contract, etc they are entering into has been fully explained to them, he said that that he is audited and this is a requirement for anyone in his line of work

im also self employed and there was no reason for the broker to put me with BF, also no CCJs or adverse credit, although i did struggle to get finance for the property i was buying, the reason being, it was empty for 2 years and was trashed but had a lot of potential, semi commercial, large flat above shop where i now run my business, saved a fortune on the rent and rates for the facrory unit i used to have, so when your struggling you do just go for what you can get at the time and think to yourself il only have this loan for a couple of years then switch to a better rate and not aware of the redemption charges because theres nothing written in a way for us to understand so were buggered from the start...so to say..GC

Should have a phone call later from the broker who sold me the whole lot, well his boss that is. Will post later with results of that call.

 

Midge, nothing at all on my agreement with regard to early redemptions.

 

speak later, may be lucky enough to have some good news but I doubt that will happen.

Hi All,

I got a letter from Click finance yesterday. They say they are unable to uphold my claim against them as I agreed to the life cover they sold me.

Funny thing is that my loan agreemene does not say anything about life insurance, it says PPI. I did not know they were the same thing. They sent a copy of a form which they get every one to sign, It just says at the top, Ensuring your policymeets your needs. It says I ticked a box to say I have retained a copy of the policy summary, but where is that then? Never seen it. If I was purchaseing life cover then surely it would have been with a proper insurance company as are my normal life insurance policys.

Seems to me it is another cop out
