      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes, I'm going to type it out tonight, & print it off tomorrow when

my main pc is turned on, I have the printer attached to that, but I have created a home network, so it makes it easy to swap files & documents, & use the printer on any machine in the house. Lol

Just read your post on my thread so had a gander at yours. Dont cave in now your so close, come on girl show them what us CAGers are made of.

I know there is ahell of a lot more than three on here, LOL, but I think our motto should be " ONE FOR ALL AND ALL FOR ONE " to pinch a famous saying.

Ive still not had a reply or anything yet from haly but as Ive posted before Ive had the same happen to me re my Abbey claim.

 

Well Im saying "claim", I use the term loosely. I sent the LBA off end of May and havent touched it since. Lack of funds to do the both claims.:(

 

Earlier in the week I was just going to have a laugh and look in the account to see IF I hadanymoney left in and Lo and Behold they have refunded me £240 .I was gobsmacked. (Not to mention tempted).Money in and I cant touch it:-x

 

I got a letter off them yesterday to say they have as a GOGW refunded me £273 (OH NO YOU HAVENT) and they hope Im happy or words to that effect (SOOOOOOOO NOT).

 

So like you Ive been running gound this site wondering which letter to use and which way to turn. Ifound what Im looking for in the templates , just need to adjust it a wee bit to fit my own circumstances. Hopefully Ill get it done tonight also Im going to include an amended spreadsheet and give them another 10 days to comply or Ill file in court. (gives me a few days to scrape the £120 together then). I hope Ive not shot myself in the foot cause I havent replied straight away, dont think I have.

Anyway the interest is growing all the time so its their loss not mine eh.

 

Well Im going to get my finger out now and knuckle down to some serious printing LOL.

 

Catch you again and chin up your nearly there, smell that lovely lolly.

Have till 09-07-2007 to file Defence.

05-07-2007--Note that Acknowledgment of Service been Filed on 29-06-2007.

Have 28 days from date of Service to File Defence.

07-07-2007--Offer from Halifax.

09-07-2007--Rejection letter sent to Halifax. Next day delivery.

10-07-2007--Money put in Account:mad:

Ja-de, have a read of the last few posts on my thread, cant believe I turned it down but I just want whats mine and I will see it through, dont see any point in writing a letter now though, so its back to waiting!! Stick at it x

You're right of course, trouble is it's a lot easier to give advice, but when it's yourself (me) it's much harder, everything seems to go out the window, 'cos your mind just goes blank. lol
