I dont very often suggest dealing with them by telephone,but I think it may be an idea to call them and ask whats going on.

 

If you are not happy after that,then its a complaint to the IC and/or a court case to force them to comply.

 

The only other option to you is an estimated claim.

You could argue that you have been forced to do an estimated based on their refusals to give you the info.

 

Call them on Monday.......go straight through to the data controller and ask them what they are playing at.

Hi

 

They did'nt send my statement either (only 14 months worth), got a letter saying the 6 years did'nt comply with the DPA and they would send them in due course. Anyway I stuck to my timetable and sent them the prem letter along with an estimated schedule giving them 14 days sent 25th July, explained it was estimate from the information I had as they had failed to provide me with my statements.

 

What I cannot understand is, Why has the Law has not enforced them to pay up when someone requests a refund. Surely they are continueing to break the Law by using the tactics they are using. If they are in the wrong they should just pay up. My mother in-law is 80 year old and she has paid around £400 but she say's she has'nt got the energy to fight them. She should'nt have to fight them. :-x

It's not been proven that they are in the wrong - they never let it go as far as court where a ruling may be asked for, therefore allowing themselves to continue to fleece people who haven't heard of this site - yet ;-)

 

Once you've been through this once, you will see that if Abbey follow their usual procedure (which for about 90% of the time they do), that it's actually quite easy to get the charges back.

 

You could take on Abbey for your M-In-Law as well ;-)

Hi Murphy, sounds as if you got exactly what i got from Abbey ie letters. Let me know when you receive the microfiche transactions. Did you complain to ICO. Martin suggested i telephone them but i wasnt keen on that idea as i end up more confused and the last time i spoke to Abbey i had words with them. You have now sent a preliminary letter with an estimate of costs, i wouldnt have a notion how to estimate from Dec 04 to July 06 my charges were approx £2,800+ (thats the statements) I have. So there is still alot of yrs outstanding, how did you work urs out.:?:

I've found this thread really interesting because its in exactly the same place that I am. My 40 days was up last Monday (24th) and I've resigned myself to the fact that Abbey aren't going to send the microfiche records any time soon.

After reading The Draft Approach in Seminoles thread sticky, I'm thinking my next step is probably going to be to estimate my claim based on the years worth of statements I have, ie: £700 for 1 year X by 6 £4100, and make a claim through the small claims for non compliance of the Subject Access Request Information and the amount I want refunded. Then amend the amount if Abbey come fourth with the statements I require.

hi there, just to let you know, i,ve just finished surfing through the last 3 years of statements with abbey which i kept safely filed away!! my saying is you never know if you need these for future reference and yes the time has come!!

I sent the sub acc request letter to abbey about a week ago for the other 3 years and yes i got the same response as everyone else they only sent me 1 months worth of transactions, how kind!!

My total amount of charges just for 3 years is 3172.00 which is shocking. As soon as i get the rest of transactions i can get to work on the spreadsheet, Would anyone be able to advise me on whether to do this in two claims or wait and do it as one?

22/09/2006 GOGW paid in acccount-800

22/09/2006-reply from complaints regarding gogw.

your call the choice will be yours.

You have a decent figure there to get you started and with interest and costs that will bump it up to a nice claim.

 

If the other years are mirrored to this you could be in for another good un.

 

 

The 5 grand tops is exclusive of interest but includes the court fee.

Hi All - Lesson to be learned, Double Check Your letters. I have just noticed a big blunder in one of my previous letter. As follows:

 

I am in receipt of your letter dated 23/06/06, outlining that you could only provide me with printouts covering recent transactions on my account, because any earlier information has been archived onto microfiche. (*I also acknowledge receipt of the information you forwarded.). I have now received a printout for Dates up to 22/04/05. At the end of the print out it states END OF ACCOUNT. I have had this account for over 6 years.

Arrrgghhhh......This should have read I have now received a printout for Dates from 22/04/05. From being the key word.

As I have not had any information previous to that date. So, as far as they are concerned I have acknowledged receipt of statements previous to 22/04/05. Looks liks another letter on the way. Annoyed Annoyed Annoyed......:eek:

Hi Murphy we all make mistakes, so dont be worrying am sure it can be rectified. Did you send complaint to ICO, i was searching this site and discovered you can do a complaint over the net. Did you also send 14 day letter. I hope you are well. Kind Regards

hello all, ive been busily working away here tonight, gathering infor, downloading and typing. Since i have had no word regarding my missing transaction charges and my 40 days is up ive wrote a prelim letter requesting bank charges from Dec 04 to June 06, secondly wrote letter re non compliance of DPA and thirdly a complaint to ICO. Will keep you all informed as to what happens next? Cheers

Hello Martin, thanks for your reply. Patience is my middle name lolo. Well ive done all that ive had to do, took ages like a 2nd job may i say. Ive a strange feeling am going to get stick, my case wont be plain sailing. When i first calculated my charges i quoted £2,800 from Dec 04 to June 06 well blow me down i got it wrong (no good at maths you see) i recalculated my charges and its over £3grand for that period and ive still outstanding charges. When you think of it £3grand has been 2 yrs salary to me. Will keep you informed and PS thanks for your support.

I actually work alongside the courts, though in a different diversion, so am used to all the jargon and all that goes with it. Have you received your statements yet.?.:mad: I have not yet received mine requested 10th June. Just wandered how you were getting on. I am due to file my money claim tomorrow. Really annoyed with them, the way they treat people is horrid, makes you all the more determined to fight for your money back. Just reading up know so I dont make a blunder (they wish). Hi Murphy. as you know i complained to the ICO, they are heading into abbey offices on 6 Sept told me to hold fire and be patient and they would feedback their findings on 11th. I also wrote to Abbey regarding the repayment of my charges of £3grand for a clatter of months. Received a letter the other day 'sorry you have to complain blah blah'. So am no further on. but abbey have til i think 15 Sept regarding my money back, plus the ICO will have responded to me by then so after all that i have to bring it all together and go full steam ahead. Keep me informed how you get on. Take care

Read your post regarding them putting the money into your account, I was passing the bank today and have not used the account since June. I remembered that they had put the money in your account so I decided to check my balance. I knew there was £3 in and got a shock when my balance read £583. When i printed a mini statement it read Charge Refund. Abit shocked really as to what they are playing at.(They must have something up their sleeve) I will leave it until the end of the week and then draw it all out (Just in Case). I will send them a letter accepting this as partial payment and give them 7 days to refund the full amount. Then use the money for my Court Claim or should I just do my Court Claim anyway (should have done it 24th August but had no money) and deduct the £580. This is an extreme positive and I feel like I am actually getting somewhere know. After all Banks do not refund £580 for nothing, Just waiting for my £4k know.

 

Have you heard anything from the ICO.?

Hi Murphy; so you got a refund as well??? They wrote to me after the event but ive since wrote back telling them to remove it the dosh as the court was officially closed in early August 2006. Like you i did not use mine for 3-4 months but kept it open and inside those months i incurred charges in excess of £1,000 so when they put the £1,100.00 back into my closed account it left a balance of 21quid as they took out their charges. Ive no word from the ICO they were to visit abbey offices today, told me they would let me know outcome on 11 Sept. So am waiting. Then based on what they say ill bring it all together and start court proceedings. Hope your doing ok. Take care for now. Keep me informed. Will let you know outcome.

Hello Murphy; thanks for your email. Your not gonna believe this i received all my microfiche records today every darn one of the them from March 01 to April 05, (69 A4 pages) now i have to scan through them to get my charges and thats gonna take a while, will do it over the weekend. I received no word from ICO todate but now that ive got my transactions which is what i reported Abbey for i believe they have done their job (very well). Hope your doing ok. Will let you know if i hear anything further. Kind Regards
