    • Thank you again. I'm hoping it will come out in the wash and will endeavour to check my online account. I'm a bit unsettled by not hearing from Booking.com but the host is sounding helpful at the moment. HB
    • I've just remembered that a friend of mine had bookings cancelled on Booking.com about a month ago - and the good news is that all worked out in the wash. I'm at work now but will scribble properly in a couple of hours with the full tale.

    • Their FAQs state - Cancellations and modifications If your booking has been cancelled, Booking.com refunds you immediately. The processing time may take 7 to 10 days and depends on your bank. If you have questions, contact your bank directly. I'm a regular Booking.com and AirBnB user.  The former have never cancelled.  The latter have and my money was refunded immediately (not that that helps you as we're not talking about AirBnB!) Best to check with your bank and see (a) if you did pay in advance and (b) if it has been refunded. Also, have you received a message from Booking.com officially stating the cancellation?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All :)

 

Im new to all this, so I hope im in the right place and doing this correct and although I have read loads of the posts on this site im not totally up on the lingo LBA, MCOL?!?!?. So bear with me if i get a bit confused.

 

Having read the threads on this site, im not liking the sound of YB, they seem to be the worse for delaying tactics and dragging their heels.

 

I sent my letter asking for 6 years details of default charges that I have paid along with the statutory £10 fee as advised on this site. That was on the 24th April .... the 40 day count down has started, but can someone tell me, is it working days or just 40 days including weekend.

 

Also sent off for my husbands, and plan on following all 3 claims through to the bitter end, no matter how long it takes.

 

Will report back once I have further info.

 

If some could just clarify the 40 days point for me I would be grateful.

Oh im ready for them to mess me about, seems like the are messing everyong around, all the other banks seem to be a lot quicker off the mark in dealing with this. To be honest im not sure how long I have banked with them, its probably a lot longer. How can i correct my mistake now, or have I messed up at the 1st hurdle? Cant believe I missed that point, I have read so may threads my head is in a right jumble.

 

Westwell, i have just found your previous thread where you were discussing claiming more than six years. I will find out how long I have actually been banking with YB and request all documents required, it will be worth sending them another 10quid, to get all my money back. :)

If you used the template off this site it doesn't actually mention 6 years but if you stated 6 years you could send an amended letter saying you require all info since your account was opened. They are required for the £10 maximum to send everything. I actually sent another £10 for my older statements because it was quite a while afterwards I found out we could claim longer and I will claim the £10 back off them anyway.

Hi

 

Unfortunately i was given a site address by a friend so didnt find this site until after I had sent my letter which does state 6 years worth of history.

 

I will send an amended letter stating I require everything from since my account was opened.

 

Do you think i should send an additional £10 or just the letter and see what happens?

Thanks for the advice. Amended letter posted this lunchtime, will see what happens, if they ask for another £10 I will send it and just claim it back.

 

My 40 days for my original letter is up on the 3rd June, but as I have now sent this amended letter, I will give them a few days extra to respond.

:rolleyes: Yesterday 11th May I received what is obviously a standard letter from Yorkshire bank acknowledging my request for statements. They are happy to provide me with statements though they have advised they have 40 days from when the fee was paid which according to my internet banking they took the money out on the 2nd May. I had already calculated the 40 days would be up around the 3rd June.

 

Im not too sure about the paragraph further down the letter which states:-

 

"Please note if you have requested any information relating to manual intervention on your account, there is no specific mention of manual intervention within the Data Protection Act and as such we are under no statutory obligation to record or provide this information"

 

Surely thats not right - Can someone help me with this part. Obviously I want to know all the manual interventions thats probably how most of the charges have happened.

An update on my situation. Still no statements received and the 40 days is now up. I tried as someone advised on this site it had worked for them, to ring the Code Compliance Officer, first asking for CCO, then asking for her by name given on here of Wendy Melvin, but apparently no one had heard of her. Was passed around several times and ended up in someones mailbox, who gave me another name and number to call a Gordon Watts, whose mailbox was also on. Left a message but received no call back. I will attempt to get hold of Mr Watts again on Monday morning but failing that i suppose I move onto the next step.

 

If anyone has anything else they think I should suggest first though please let me know.

 

My husbands is going a lot better than mine received all his statements this morning (he is with a different bank though and obviously adhere to conducts!!)

Im gobsmacked ... received a telephone call this morning from a Gordon Watts, who is a code compliance officer for YB. He knew exactly why I was telephoning and that it was in connection with me NOT receiving copies of my banking history with YB. His explanation and I quote ... 'as you can appreciate we have been inundated with requests for banking histories and our systems that were in place have been unable to cope with the volumes requested'.

 

I explained that YB had cashed my cheque, and we were now well over the 40 days and they had not complied and yet my husbands bank had how does he explain this ... his response was if i have not received any of my information by a week today ie 18th June, i should inform the Information Commissioner ... Er hello, I think i will be doing that now, they have had there 40 days.

 

All requests which were in from the 24th April which will be mine should he said be printed and sent out this week. Wont be holding my breath on that one ... will try e-mailing this Wendy Melvin this afternoon and see if I can get anywhere with her, if not I will go to the information Commissioner.

I have this afternoon e-mailed Wendy Melvin at Yorkshire Bank. I have received no failure report to suggest that my e-mail has not reached her.

Will give it to the end of the week and if nothing still received i think im gonna have to contact the information commissioner.

Friday 15th June I went down the Information Commissioner route, logged and online complaint against my bank YB.

 

Does anyone know how long this can take to have any affect, do I have to wait a certain amount of time before I can do anything else and if I do anything else what do I do?

Hello Wobbles,

 

My 40 days for pre 6 years is now about 5 weeks late. They did say I should receive these statements middle June which should be anytime now.

 

Well I wont hold my breath mind...

Spoke to ICO today, just really trying to find out how long I now have to wait or is there anything I need to be doing. Spoke to a very help lady (didnt catch her name) who said they would write to me within 14 days advising what I do next, and that I was not to do anything until I had heard from them

 

I still have not received my statements from YB.

Whey Hey ... my statements have arrived. Although on having a very quick look at the dates it appears they have only sent me 6 years worth and not my entire banking history with them as my amended letter requested.

 

Not sure I should persue the remaining years or if I should just make do with what they have sent as it has taken them so long to send these out. Whats the general feeling requesting further back than 6 years?

:rolleyes: Oh fantastic ... YB play very dirty ... to ensure that going through statements takes time to do (like 6 years worth again already enough to be checking) and gives you a total banger of a headache they have my statements back to back in such a way that the dates DO NOT run in sync, no matter how many times you go through them and try and put em in date order.

 

Well thank you very much YB ... nice try but you wont put me off, I dont care if im up all night sorting this mess your have sent me out .. you will be receiving my Prelim Letter Monday morning.

Yesterday (Saturday 23-06-2007) I have made a formal complaint to Yorkshire Bank about the issue you quote (back to back) statements that is not easy to follow!

 

I have copied my MP who is very interested in my case.

 

I suggest you complain too (can only be a good thing as a judge will not be too happy with this latest tactic by Yorkshire Bank):D
