Hi all

I originally wrote the initial letter to HSBC in February and had the standard "looking into it" response but nothing further. due to the pressures of setting up a new business, I did not return to this matter til March and on the 27th wrote a second letter informing HSBC that unless I had heard from them by my return from holiday on April 14 I would commence legal proceedings. I'm after a refund of £1200 + £266.55 in interest.

 

It will come as no surprise that there was no letter from HSBC waiting form me on my return.

 

Soooo ... deep breath ... I am about to begin the court process tomorrow. Tonight I'll revisit the relevant areas of this excellent forum to make sure I get the procedures right.

 

As a by the way, last year I managed to get a full refund of £85 from Abbey by only writing two letters.

You've been a mamber for a long time, so its nice that you have finally made a post so we came officially welcome you:).

 

I get the feeling that you are well organised with this, so I wont try to teach you to suck eggs, but will state the obvious that should you need any help/advice or just some good old reassurance, then we are all here to help each other, so don't be afraid to ask.

Thanks for the welcome Louis. Yes I've spent a lot of time reading and inwardly digesting over the last year before finally plucking up the courage to "have a go".

 

Please, feel free to teach me to suck eggs, I will be grateful rather than offended, and rest assured, I will ask - writing letters is the easy bit, now comes the bit that scares me a little as it is totally foreign territory.

For what its worth, I doubt if there are many members who havn't felt exactly the same as you are now at this stage. I have just submitted my second N1, with a 3rd and 4th not far away, and even though I have had a very good sucess I still get nervous. BUT, its a good nervous, and at least it shows that nothing is being taken for granted, and that way less mistakes are made.

 

I will keep an eye on this thread if you dont mind, and although there are a great many better 'experts' than me, I will offer as much help as possible. Please feel free to use the PM facility if you want a private discussion, or just a bit of moral support, but remember that there are lots of people, just like me, more that happy to help.

 

Just think of this a one more step on the way to a full refund.

Call me a wimp but .....

 

I had kicked off the lodging of a court action on-line (but not finished it) and then a letter arrived from HSBC offering me "without prejudice" and without admission of liability a settlement of £1080. Upshot is I decided to accept the offer in the interests of less hassle at this time (and I really could use less hassle right now!).

 

Now I know I'm copping out, but the claim was for £1200 so they have got pretty close, and yeah I know I would probably get another £300 odd in interest, but £1080 inside 7 days seems like a result to me considering I've only written two letters and if I'm honest the way I conducted the account til half way through 1995 was pretty poor and probably deserving of some sanction.

 

So, please don't give me too hard a time - I'm just looking for a quiet life!

 

Thanks to all on this forum who have helped me, and to all of those whose posts I read and took inspiration from.

my case against hsbc is in the money claim online system. they have just written to me to say the case has been refered to the district judge and i will hear something in 3/4 weeks. is this normal?

There are many forms of hearing currently being used, this isn't anything to be worried about. Wait for the judges directions, and if in any doubt post them here.

 

You really need to start your own thread, as it will get too confusing.

 

Find the forum the corresponds to your bank and begin a thread.
