I have to do some proofreading of an English grammar book for an Italian publisher this weekend - for money! - so I'm afraid corrections and suggestions will come in dribs & drabs.  I've totally knackered the layout, the numbering and the order of your Exhibits but there will be several versions done so don't worry about that ATM. Your arguments are superb. What is less superb is the way you jump from one to the other and back again, so I haven't changed your words, but I have moved the paragraphs around and given each section a heading. New bits are shown in red. Crossed out crossed out in black is something you've quoted from the government Code of Practice, but that has since been withdrawn so unfortunately that argument has to go. Your paras 7 & 8 don't harm your case but to me are waffle and can go.  Keeping the arguments clear & concise will always impress a judge. IMPORTANT - did you ever send Simple Simon a CPR request?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I already went to nationwide online and filled the form in. I got a customer number and they will be writing within a few days so I'll wait and see what happens with that...

I'll check out natwest if there's a problem with nationwide though.

Is it Bradford Combined Court? Haven't found a county court in Bradford that's all.

I would count the 40 days from when you sent the letter, or if you want to be extra-nice 40 days from when they should have recieved it.

Right i posted the SAR 3 days ago now recorded and STILL no confirmation of delivery. Ive tried the website and the number on the back and just got told 'Recorded signed for is not guaranteed delivery!'

What have I paid £1.04 for then Royal Mail if you don't deliver?

OK. We recieved a list of charges this morning in what i think was a response to our first SAR, even though they are a month late.

My problem now is what to include on the schedule of charges. So far I have listed all charges except O/DRAFT INTEREST and ACCOUNT CHARGE. Now I know that I don't ask for interest just yet, but I want to claim 29.8%.

Do I keep this rate for all the charges right back to September 01?

If not, what rate(s) would I use?

And why can we not claim back any ACCOUNT CHARGE charges? I presume that this charge if their fee for managing the account, but as far as I can see, they haven't managed the account at all. If they had, we would have recieved a letter warning us everytime we were about to go overdrawn, so we could do something about it, instead of a letter telling us we are overdrawn and would be charged again.

 

Also, how are you supposed to work out how much of the interest they've charged you is claimable?

 

If anyone can help please do!!!

Yes the total charge amount is £2037.50

But to todays date there is £4420 worth of interest at 29.8%

It is a much higher risk unless you are FULLY PREPARED. If you feel confident claiming CI then go for it - but please be fully aware of all the potential pitfalls that may arise - have you had a good read of other CI claims on the site?

Ive read so much that I sometimes think my eyeballs will turn inside out :eek:

I know that I could potentially be liable for their costs. I suppose if it goes to court I should hope for a good judge with some decent experience of this...

All I seem to read though is that if you follow everything correctly as set out on this site, then you shouldn't lose. At the end of the day, as long as my argument is correct, they'd have to justify that their charges are fair to win - which they can't do.

Just drafted the prelim today. The second S.A.R - (Subject Access Request) we sent hasn't even been delivered :mad: so we're just going for the 6 years of charges we have already got. (and i'll be claiming compo from royal mail too!)

Looked into the contractual interest and it is all very complicated and confusing and I don't want to get anything wrong so we're just sticking to the statutory 8%. That will be an extra £500 which is better than nothing if it gets that far, which we all know it will.

So hopefully we will hear something in the next two weeks if they're not too snowed under, even if it is only the standard reply.

I can't wait!!

Quick question. The prelim got delivered today but we received a letter this morning saying that £80 would be taken out on the 1st June. Can they do this once they've received the prelim as the account will be in dispute? Even though they sent it before the prelim was received?

Well today we received the standard bog off letter-quite quickly too. It was dated the 11th and we only sent the prelim on the 8th.

My question now is can we contine with the lba even though the 14 days aren't up yet?

If we do, and send the schedule of charges as it stands now, will we be able to add on the further £80 of charges due to be taken on the 1st June as mentioned previously?

Couldn't they use that against me though if they receive my lba before the 14 days are up? Couldn't they say that I didnt give them enough time to comply even though they already responded?
