Hi all.

 

This is my first post to this site after countless hours of reading through other people's threads, the FAQ's, Important announcements and so on.

Even though I have spent a lot of time reading these I still feel I will need a LOT of help as my claim progresses!:confused: There is so much legal jargon and it seems as if everything must be done perfectly so as not to waste time or get things wrong.

I am filing this claim on behalf of my fiancee who is absolutely useless with money. He has had a personal account with Lloyds for about 17 years and over these years must have paid several thousand pounds in charges. I think it's time he got it back.;)

 

We discovered Martin's site a couple of months ago but didn't thoroughly read it all. The first letter we wrote was very brief and went like this:

As you can see - it isn't very good. We were advised by Lloyds to drop this letter in at the local branch. This we did on the date shown.

After 21 days (7-3-07) we recieved a letter explaining that as no cheque had been included in the letter and no direction to remove the amount of £10 from his account was given, they still had another 40 days from when they got the cheque to provide the information. We sent the cheque the same day to the address provided (can't remember it now) but it was not by recorded delivery which I now realise was a mistake. The cheque to this day has not been cashed.

 

What am I to do now? Should I write another SAR and cheque and send by recorded delivery?

Or should I try to contact someone within Lloyds asking where the statements are?

 

Any help on this would be fantastic. I will need all the help I can get

I would send another cheque with the SAR from the templates library just to save any confusion, if the first cheque was received without an SAR to cover it, it could be that no-one knows what it was for and so it has just been put aside.

 

Think you'll find the CAg letters a little more 'persuasive' than the one you previously sent.

Thanks for your quick reply Ian.

I have alredy prepared a new SAR with the help of this site. It looks 10 times better!

It's just annoying that we started this in February and have to start again already.

Also, which address should I send it to by recorded delivery? From reading other posts, several addresses have been used but all the replies seem to come from customer services or the Statement Copy Unit. Would it best to directly write to one of these?

I'm not too sure this bit is true. someone with more knowledge will be able to help but i remember reading a thread where something similar had happened and i'm fairly sure they used the date of first SAR as they had proof it had been recieved they just had to pay the tenner.

 

Don't worry. Someone that's clever and can remember things properly will be along soon :rolleyes:

Thats just it though. We don't have proof of the original SAR being recieved or the cheque either.

Think it'll be best to just start again with new SAR and cheque sent recorded delivery to the earlier address.

They wont get round me again!! :)

Do you still have a copy of this letter? If not would advise buying a folder and putting all letters sent and recieved in it. You're going to need tham later.

No. We have moved since then and we thought that if they recieved the cheque we would get the statements no questions asked. Yeah...

I will be saving every bit of correspondance from now on.

Does any1 actually know how long Lloys keep records for including the microfiche data? And has anyone got more than 6 years worth of charges from them? Would like to know so I can amend my SAR to include these facts before I post it off tomorrow.

Thanks but this link doesn't contain any lloyds info. Im just gonna ask them to send me data from as far back as they have it.

 

Just seen that someone got ther's back to 1997 when the account opened!

I got your PM.

Looks like nicsussex and iancognito are already helping you out a bit here, so your in good hands.

Regards your course of action, I would suggest this:

1/ Folow the advice given above regards getting your SAR info. Simply post EVERYTHING as recorded to and from yourself and bank, any solicitors etc. If you send the £10, what I did was got a counter cheque from my branch for this rather than just write one out of my own chequebook, this way you also have proof that the cheque was raised.

2/ There is a lot to take in on this site, and it can all be very daunting, and confusing at first. But remember you have time !! Don't feel as if you have to do this all within a few days. READ, READ and READ ! Don't rush and make mistakes.

3/ regards you question about interest. In simple terms what you are claiming for is the interest you paid out as a result of the charge.

So say for example you have a £100 overdraft and £10 of that was due to a charge. The Bank then charge you 10% interest (remember this is just a simple example, so the interest rate is not correct), and this 10% interest means you pay them £10... well this means that as £10 of ther overdraft was due to a charge you should never have had, then you should not pay interest on it ie. £1 of the £10 interest you claim back.

Do not worry about this too much at the moment though, once you have your list of charges then you can start a spreadsheet which will work this all out for you, and tell you what and how to enter stuff.

Another question for anyone who might know.

 

Which is the best bank to go to for your parachute account? He doesnt have a passport or a driving licence so im assuming it will be hard for him to open one anywhere.

Would it be easier if he just joined my existing account??

OK so I sent of the SAR this morning - recorded delivery - but I still don't know what to do regarding a parachute account. Ive looked online at the ones above, amongst others, but without a driving licence or passport it just seems impossible to open one.

 

What can we do???

 

My fiancees wage is still going in to the account (even though it doesnt take him out of his overdraft) and there are several DD's and a standing order through the CSA which took months to set up in the first place. :(

 

I WOULD BE MOST GRATEFUL FOR ANY ADVICE :confused:

HAVE A GOOD LOOK AT NATIONWIDE WEB SITE.

 

TO OPEN AN ACCOUNT WITH THEM THEY WILL ACCEPT AS PROOF OF NAME A RECENT BANK STATEMENT OR HM REVENUE AND CUSTOMS NOTICE OF CODING ie tax coding.

 

To get a notice of coding if you do not have one just call HM Revenue and Customs number from tne phone book and they will sort you out.

For a parachute account the Natwest Step account is really easy to open. You can do it online, I didnt need to go into a branch or provide passport or birth cert etc. It's just a basic account the only identification information they asked for was last months bank statement showing my salary being paid into my account. I sent that off and the account was opened straight away. You can set up DD's and standing orders from it. I doubt I will ever use it but it's there - give it a try
