Hi everyone,

 

Just got off the phone with a friend and she's concerned that the halifax have not responded to her DPA request. The request was sent to them on the 3rd May foolishly by standard 1st class mail :/

Whats her best course of action now ? wait out the 40 days, send them a reminder (by recorded delivery) or start from fresh sending a new request by recorded delivery and wait to see if they respond to that ??

 

Is it more than likely that they are just pretending they haven't received the first request or are they just really slow ?

 

I know from my own experience it was pretty hard work getting all the documents i'd requested and on checking through thoroughly I have now noticed they have missed out some of the info I'd requested..........grrrr

 

any advice greatfully received :)

sorry to sound dim but whats special delivery ?

 

I believe (correct me if I'm wrong) that Recorded Delivery can take some time to arrive at its destination.

 

Special Delivery guarantees you a next day delivery. You can check it's been delivered too, from somewhere on the internet.

 

It's not cheap though, it cost me £4.10 per letter.

Data Protection Act sent to Barclays Bank 15 May 06.

 

Bank statements received 9 May 06. Owed £610 in charges and £31.96 in interest.

 

Prelim letter sent 15 Jun 06.

 

Letter Before Action sent 26 Jun 06.

not cheap I agree but I guess it's not a lot to at least give some peace of mind that the letter has actually been received.

 

I handed two letters personally over to a staff member in my branch and they still denied receiving them :/

You are right but also the reason I don't like recorded is that it is treated as normal mail until it reaches it's destination, then it gets signed for, it's no more reliable than 1st class mail, whereas special delivery is held securely and signed for each time it is handed over to another member of (Royal Mail) staff.

By the way...the 40 day period is the maximum time permitted for them to produce the statements so I would certainly be chasing them up for the statements by post/email/phone on a regular basis throughout that 40 day period rather than sit waiting for 40 days before chasing it up only to be met be a blanket denial that they ever received it in the first place. :)
