  5. You are of course able to instruct a solicitor to represent you at any time. However, if your claim falls below £5,000 you will NOT be able to recoup any solicitors fees if you are successful over and above the fixed costs you can claim IF you have instructed someone. The fixed costs are really a pittance - about £80 or thereabouts. So you could end up spending more on legal fees than your claim is worth. For example my hourly rate for inner Cardiff is currently £163 an hour - as set by the Cardiff County Court. However, it's a double edged sword. As you cannot recoup any legal fees YOU incur neither can the bank recover against you any legal fees they incur should you lose - as long as the claim remains below the smaall claims limit of £5,000. So you can issue proceedings safe in the knowledge that the most you can lose is the issue fee.
  6. This is normal hon. However while they have repaid the charges they have yet to refund the issue fee or the interest (I assume you claimed interest on your charges?) They seem to send a letter out some days later....crappy admin system I expect. If the deadline for filing a Defence had passed then you can apply for judgment for the balance due. Or you can leave it - whatever you decide to do is your choice. Alternatively you can contact them and point out they haven't paid the charges and interest and until they do the claim is still active.

  8. Not that the grief is worth it but look at it this way....6 years worth of charges with 8% interest isn't that bad a savings plan eh? I issued 2-3 weeks back so just waiting to see what happens. Knowing my luck I'll be the first to end up in court. Just knowing you can fight back makes such a difference doesn't it?
  9. You might find this interesting hon: From a letter I had from the Halifax dated 17th May 2006 in relation to my current account. "The majority of the transactions on your account are automated and all application of charges is automated. The only manual intervention around charges would be when a refund is made." It's signed by Shirley Clark in Customer Services.

  11. ((hug)) Get cracking straight away hon. Take the initiative. I know it's tough when you've been hammered by them for so long but once you've started it feels really good believe me.
  12. If you read back a couple of posts you'll see I issued proceedings a couple of weeks back. They have filed the AoS as I expected so I am keeping an eye on my account with them to see if anything suddenly arrives. They have until the 21st to file a Defence.
  13. Has anyone had their claim by the Halifax defended to a Hearing since I last caught up with all your tales? Or are they still paying up between filing the Acknowledgment of Service and the Defence? There are frankly too many threads here now for me to plough through them all so see if that's the case.
  14. Both claims acknowledged on 25th and 26th July but nothing more heard as yet. I'm a little ticked right now as I used my Halifax debit card earlier at the PO to pay for mail redirection and it was declined twice - my local PO where I'm known as well. I only used it as my other account is a Solo account as I didn't think the PO accepted Solo - thankfully they do.
  15. Well there we go. Small delay there while I got my house move out of the way. Boxes everywhere but at least I'm in and reasonably solvent for the next few weeks. Anyway....proceedings issued today for current account charges (about £2,500) and Halifax credit card charges (£650). I have identified the Halifax registered office at Trinity House, Halifax for the credit card claim since I want to avoid any Scottish involvement if at all possible - from a purely legal perspective of course. Fingers crossed.

  17. Sorry I haven't been about much lately. New job and moving house and all. Anyway just had a call from the Halifax to say that unless I make a payment of £111 to bring my account within the £90 OD they will "take matters further". I told them to do what they liked but that if they refunded the unlawful charges then I would be significantly in credit. All I had was a puzzled tone and the remark that the charges were lawful. I should have issued back on the 20th June but what with the house move and all have been putting matters off. Roll on next Tuesday when I do move and I can crack on with this. Hope you're all doing well. xxx
  18. You wait. Check the date of service - it should be a couple of days after the date of issue. They have 14 days from the date of service to file an "acknowledgement of service" (AoS) on which they have to state whether they intend to defend the claim. They will tick that box since that then buys them another 14 days (so 28 days from the date of service). If they don't file an AoS within 14 days you can fill out the application for judgment making sure you've totted up the interest to the date of judgment. If they do file an AoS saying they intend to defend then you have to wait until the further 14 days is up before you can apply for judgment - unless of course they have filed their defence. Hope this helps.

  20. You should not be charged £28 every 3 days hon. The charge for meeting payments when there are insufficient funds is now £39 so you have 2 of those and the £28 will be debited for going over your limit by a certain amount. It should however be a one off charge unless you can get the account back on track soon. If not then you will have another £28 charge next month. Firstly I would suggest calling at your branch to see if they will rescind one if not more of those charges but I doubt they can/will be able to. The only option then is to follow the usual procedure for suing thyem to recover the charges - assuming you know the extent of charges amde to your account over the last 6 years. it's a complete pain hon and my sympathies to you. (((hugs))) I was charged nearly £80 when my own statements don't even show mne going overdrawn. When I queried it it was told they "calculate it differently at head office". But how else are you supposed to manage your account other than by reference to your statements?
  21. By the way my "manual intervention" letter from the Halifax was phrased slightly differently. It says: "The majority of transactions on your account are automated and all application of charges is automated. The only manual intervention around charges would be when a refund is made. Therefore if you require any further information please contact us." The letter is signed (a computer generated signature of course ) by Shirley Clark in Customer Services.
  22. Hi Duncs. I had my statements on Day 39 so hang on in there. They WILL drag it out. But I did finally get them 4 or 5 days after getting my "manual intervention" letter. From then I just totted up the charges and sent off my request for payment as per the FAQ's.
