    • Please read the following thread very carefully. It is extremely relevant where you are suing Evri on the basis of a contract which you originally made with Packlink who are domiciled in Spain. A judgement has been obtained and we have applied for transcript and it will be put up on this thread as soon as we receive it probably about the end of July. In the meanwhile, read this thread, see what has been discovered about the Packlink/Evri/customer relationship and look at the witness statement very carefully. It's a long thread but don't give up.     • So if the breach occurred say Dec 2017 (first missed payment) and the default notice was issued Sept 2018 and the claim was issued 7th June 24 the claimant will of course be arguing it is within the limitation period (by 3 months)
    • Yep, I would  have brought up the other things like asking for their contract and receiving no response etc. but the mediation phone calls were rather short. Evri just said the contract was not with them (i said 1999 act response etc.) and the goodwill offer thing. Whole process took about 10 minutes in total. Seems like they don't even want to negotate in mediations anymore. "they're only given a certain amount that they can agree to in mediation per day" I mean its hard for me to say if thats the mediator paraphrasing or aa direct quote from evri I will look through that thread and share what I find, also for what its worth I also have everything I made for the previous claim WS and bundles etc. that I can tweak for this parcel, since it did go almost all the way to court and is a virtually identical case. that + this new stuff you shared above should be helpful to me
    • If I haven't referred to it before then please check out this thread another case where the claimant contracted directly with Packlink for a courier delivery service carried out by Evri. Please read this thread very carefully and eventually you will get to a point where the claimant – our OP – discovered some interesting terms and conditions and has referred to them in his case. He incorporated these into his witness statement and was given judgement – not on the basis of rights of third parties but on the basis of direct responsibility. I would suggest that use the witness statement as a model although we will want to see it before you file it off. When you find the particular post with the witness statement, please can you post a link to it here as well as a copy of the witness statement because I don't have the time to look for it at the moment and the thread is rather long. However it is very important to you and you should go through it very carefully indeed. We have applied for a transcript of the judgement and hopefully it will be along in six weeks or so. As soon as we receive it we will make it available on this sub- forum.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

thanx lattie, mines on there, chichester court, although im sure they told me all claims there have been stayed, will find this out for sure

but al deffo gonna appeal, got a kick up the rear earlier so im eager to carry on with this:mad:

 

and molly what faults might these be?:p

 

Lol some of our offsprings faults are best kept to themselves :lol:

As you have stayed up (sorry to use the word stayed!) so late this one is just for you lat!!!!

 

A cargo ship was sailing across the sea from Spain to New York with a shipment of animals for a local pet store. They saw an island and decided to land and see if it was inhabited. As they were sailing up to the shore, the waves suddenly shifted and sent the ship plunging into the reef. The only survivors were a man, a sheep and a dog. The man survived on the island well enough on wool from the sheep for clothing, food from the plants on the island, and companionship from the dog. This wen on for quite sometime, when the man started feeling his...uh..."manly urges" arising. He ignored them for awhile, but they eventually got too strong to bear. He was looking around for some way to relieve these urges, when his eyes fell upon the sheep. "Well, no one will ever know" he thought. He caught the sheep and started "performing the deed", when the dog came up and attacked him. He ran off and the dog stopped. When he went for the sheep a second time, the dog attacked again. This went on for awhile, until the man finally accepted defeat. He climbed to the top of a cliff and was about to throw himself off, when on the horizon he noticed a sailing ship heading his way. He signaled for help, and the ship prepared to land on the island. Just as it was about to, the waves shifted again and threw the ship against the reef. The man could hardly believe it! But, he looked down on the beach and saw someone pull themself out of the water and collapse there on the sand. He races down and discovered it was an absolutely gorgeous woman. He administered CPR on her and soon she was revived. She was so happy to be alive, that she looked at him and said "For saving my life, I'll do anything you want." The man looked at her with growing excitement. "Anything!" he exclaimed. "Anything your little heart desires." she said. "What'll it be? What do you want me to do?" The man looked at her and said, "Here, take this damn dog for a walk will ya?"

Just to make sure I'm down there with Freaky heres my contribution....

 

A young couple were married and celebrated their first night together, doing what newlyweds do, time and time again, all night long.

 

Morning comes and the groom goes into the bathroom but finds no towel when he emerges from the shower. He asks the bride to please bring one from the bedroom. When she gets to the bathroom door, he opened the door, exposing his unaroused body for the first time to his bride.

 

Her eyes went up and down and at about midway, they stopped and stared and she asked shyly, "What's that?" pointing to a small part of his anatomy. He, also being shy, thought for a minute and then said, "Well, that's what we had so much fun with last night."

 

And she, in amazement, asked, "Is that all we have left?"

Well I've only been away 1 week feels like a lifetime!! My AQ went in on time 17th July - DG have failed to submit theirs..but told by court not to bother trying to do anything abouth this cos it's with the judge and I will hear in about 3 weeks ?? Just seems so unfair I HAD to get mine in for 17th and they have just ignored the courts like they have me all this time...where do I go from here ???:confused:

charlie I personally would not wait.. it coudl well be that the court are saying that in order to give themselves some breathing space and clear the back log.........

 

I woudl risk it for a biscuit and ask for it to be struck under the courts own rules of procedure........

 

you can bet your bottom dollar if it had been the other way around DG would...........

Thankx Lat and age etc - I'll look and see what rob the viking did in his punt!! I think what has put me off is that when I asked the court official on the phone if I should do this he said it would be a waste of time ??? So why did I bother filing an AQ and paying £100 ??? Totally do not understand this situation :-x

the courts told oyu that because they are creaking under the pressure, they are hoping that when they tell ppl that it willdeter them, thus making their work load lighter........ tisk tisk.....

 

I yesterday handed in an appliction to the court to have the stay remvoed and I asked for a hearing to determine this........ if you had seen the court managers face!!!!!!!!!!! that is usually done by solicitors........ oh right was my reply........

 

and once I have got my hearing date and it is sorted. my next move is to send a formal complaint to the MOR with regards the judge as to why he failed to adhere to the courts own rules.........:D

 

do nto let them intimidate you charlie, there are enough people on this site who will help you through evrey step of the way............

 

I would not have gotten this far had it not been for Lattie, PD, Freaky, Pete, CM and a few others........ read up on the removal of stay thread and get yours request al ready. you can dl the N244 form online and have it all ready fille din. so as soon as you phone the court and they tell you it has been stayed you can get it in..............

Thanks age - I'll look on your thread and pick up details of yours - just wonderin what letter to use to the courts - as a stay hasn't acutally been applied yet ?? so I need a letter asking the courts for a strike as DG haven't responded with their AQ or anything ?? Any help on a letter???:confused:
