They took my name/ address/ a picture of me holding a signed banned letter. the only questions I've got are... will I be contacted by the police will this be recorded as police caution or criminal record?  I would really really appreciate if you could let me know how it went.  I am so so so ashamed of myself and am really making changes in my life I feel like I've lost myself for a period of my life but anyways it would be really great to hear back.     • I thought Delinquent ment "missing payments" its active so assumimg it can be seen ? also this is the only thing change on my credit file and that in its self being re added has dropped my credit score . the debt is SB and did drop off my credit file so how have or how can they re add it again ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hello everyone i started my quest back in feb 27th o7 and getting a bit fed up with hsbc now! they sent the usual delay letters asking for it to be set out a certain way then filed mcol after no response they acknowledged then defended yesterday ive just sent a copy of charges to dg and waiting to be transferred to local court ( i should have done this when i filed mcol! oops! ) does anyone have any stories from this point about what will happen?

Once your case has been transfered to your local court, you will get a notice of a hearing of some sort (mine was a preliminary Hearing). The AQ will probably be dispensed, but depending on which court is your local court you may still have to do this. Give it a week or so and give your local court a ring to see what is happening and whether you need to pay AQ fee.

 

Once your local court has been in touch with you and informs you of the next stage, put a post on here as to what is happening and then someone can advise on the next procedure.

 

Keep nudging DG once every 10 - 14 days or so.

recieved notice of transfer of proceedings to durham county court AQ has been dispensed and the usual defence i have sent a letter to dg is there any thing else i need to do? or do i wait a week then contact the court to see what is happening?

There may be a little wait for your local court to get in touch with you. Start nudging DG every 10-14 days or so. Your local court may still insist on an AQ. Wait a week or so and if you haven't heard from them, give them a ring and ask whether an AQ is to be done and if not, is the AQ fee still payable.

I am in the same boat. I have a prelim hearing on 25th July. I sent draft order the other week to the court. Also I am now going to be sending my 4th or 5th nudge soon (there have so many, I have lost count). Just be patient. Some people have had to prepare and send off their court bundle (14 days beofre court date) and then they get the offer. But don't let that discourage you, I don't think anyone really knows how DG sort out which offers need to be done first.

hello there, i have finally recieved a courtdate of 28 august after my claim was sent to the wrong court then it took them ages to get back to me and when they did i was on holiday! the aq has been dispensed with but i still had to pay the 100 quid ive sent another letter to dg my bundles have to be delivered by 7th august help!

yes, that's what you've said -

so, three bundles - one for the court(send recorded or deliver), one to dg (send recorded delivery) and keep one.

 

might as well get moving on it - and once done - send dg's to them -

they tend to make an offer upon receiving the bundle.
