Hello all,

I am so happy to have found this forum:D . I really need some help claming back the charges from 3 catalogue companies that have passed my account over to DCA.

Q1 who do I send the CCA letter to? and do I send this before SAR letter.

Q2 Do I send SAR letter to the catalogues?

The CCA request should give you the original contract and should extend to statement, however to obtain all the statements including the charges then it would be best to send a SAR, this should be sent to the original debtor. The CCA would be best sent to the DCA's so as to see if they are Agents for the catologue companies or have actually bought the debt and to prove they have the contract so have a legal right in pursuing you for the money, good luck.

SARS to the catalogue companies themselves.

Can send them at the same time, or some folks send the CCA first to see if there actually is an agreement in the first place. No agreement means it can't be enforced without a court order. But, I think catalogue companies work slightly differently - suggestions anyone?

My Mrs has just had debt written off by a catalogue company because there was no signed agreement but she still wants her statements and has filed a claim in court for this. Our CCA was sent to the DCA and the SAR to the catalogue. We never received the statements hence the court claim. The debt was quite small which is probably why they wrote it off instead of sending the statements and finding that the charges were more than the debt. I personally would request my statements before the CCA.

Martinhw, if you have had the debt written off, why are you asking for your statements? It could rather difficult if you are looking tio reclaim your charges

from a debt that you do not acknowledge.

 

We did not ask for it to be written off. It was a case of a CCA for the copy of the agreement so we could check the Terms and Conditions, Interest rates, PPI etc and then the standard SAR to get the statement of account. As the catalog Co. could not produce an agreement, they took it uppon themselves to write the debt off. I know for a fact that the charges on this account were more than the balance, hence the court order. We acknowledged the debt and were prepared to settle it, but I think the Cat. Co. is trying it on by saying they will write it off.
