Just telephoned Borehamwood (0208 236 8007), as I sent 1 LBA on 3rd April and one for another account on 10 April. Was informed by a gentleman called Alan that it was their aim to clear any claims within the 56 day FSA deadline where the claim did not include interest.

 

He also mentioned that they were snowed under with claims at the moment! So if anyone is in the same position as me, you may want to consider holding off the action for a week or two in case they meet your claim in full (and thereby save a couple of hundred quid in court fees!)

Thanks for this parky, I could contact them, but I know a couple of people on here have had problems with this collections centre too so I just wanted to hear if this sort of nonsense happened to them

Hi choco

I had a letter stating that all action had been frozen for a month ( it didn't explain what the action actually was) I just presumed it was the charges - it turned out that they just meant not sending it to a debt collections agency.

They basically carried on charging me and adding on interest until they paid my money in and the charges swallowed it up.

I now have to start a new claim for the last two months worth of charges which were applied whilst they were sorting out my original claim.

Save all your letters that you have sent them and after all this is finished write a complaint about the way you've been treated ( which I have done) If you don't get a satisfactory response complain again to the financial ombusdman.

How come you're expecting a cheque? I always assumed that if you owed Natwest any money they would just take the refund as payment for the debt - I could be wrong but it's worth double checking:)

In my experience Birmingham collections were terrible to deal with they agreed one thing but did another.I never got any responses from my letters from the same person twice in a row ( although all my letters were addressed to the same person) and I personally felt that they didn't care one hoot whether you were claiming back charges or not.

Hi caz

 

First off the cheque thing is just my way of saying i still havent got my money back! ;) I know they'll use it to pay off the debt, which I dont mind anyway cos that's what I was goign to use it for.

 

Now as for this collections dept, they haven't even said that they're going to freeze action or anything, the only part of my letter they was concerned with is the part that requested them too not charge me!!

 

So what should I do, do I write back asking them why they haven't addressed the main issue in my letter?? Oh I also forwarded details to the BBA website, I'm awaiting an e-mail from them to see what they have to say about it.

Who do you address your letters too? I didnt even have a name at the bottom of my letters from them, it just said the collections manager!

Mine was the collections manager ( my first one) then Mrs.Earl replied to that - so I wrote to her.

Definately write back and ask them why they haven't addressed the issues tell them you want a full explanation and good luck hun xxxxxxx

I hope everyones one step closer to getting their money back!!

 

I'm claiming back for 2 accounts, and so far I have always sent them seperate letters for both cases. Do I just put it as one grand total on the court forms??

Choco, If you haven't put a court claim in then it makes sense to put them both together. When you claim. Byeeeeeeeee

It just seems like I have the worst luck, AND I have to pay £120 for my claim, I know I get it back but i still have to pay for it, God knows where that money's gonna come from, why they cant just pay up is beyond me!!!

Hi, just started my own claim. Have had problems with Birmingham Collections on my other account, which I haven't started a claim for yet. Am paying in an agreed amount every month to keep them off my back while I sort out the claim on our Advantage Gold account, then gonna hit em for the current plus account which is the one that is with collections.

 

Anyway, couple of weeks ago managed to speak to a very nice chap at bham collections, this was when i was trying to track down whether they'd received my letter requesting statements etc. unfortunately I was so fed up with them at the time I can't remember his name.

 

BUT THE POINT IS.......... he gave me the fax number for Birmingham Collections, so if you have any letters to send, fax them as well, so you know they've received them. They'll probably still not reply but its worth a try.

 

FAX Number is 0121 566 1521.

ooohh thanx a lot for that, I just sent them a reply to the unhelpful letter they sent me, but I get the feeling I will be sending them more correspondance so i'll save that for future reference.

 

PM that fax number to a mod and they'll add it to the contacts thread.

They are so unpredictable. They also are very arrogant. I know it is very hard especially paying court fees etc. From alot of the threads posted i know there are alot of people waiting. I waited 11 weeks for the court to give me directions. Not the bank the court. Nat West have the power to stop this ridiculous situation, but choose to rub peoples noses in it. What can we say ? :mad:

Because they're determined to do it the hard way so am I!!! A friend of mine is also waiting for the courts with his abbey claim!

Somewhere it says you can issue a form to claim remittence, so i printed this off, as I feel I may be eligible, as I have so many outgoings at the mo and the citizens advice helped me do a form that breaks down all my outgoings and so far one credit card company have accepted it and accepted my offer for reduced payments! anyway, there's nowhere on the MCOL website that gives you an option to do this?!! I'm confused, does that form only apply if you go into the court and file your claim there ???

Hey Wendy, I remember those days when i was a newbie... lol and your right, this does take over your life!!

 

Bookworm is one and also Robertxc, to name a few, pm them and say you would like to add that to the contacts thread. As you go through peoples threads every now and again a helpful mod comes in and adds there 5 cents and it will say moderator under there name, so thats how you can tell who's who. It would be a good idea to have a thread that lists all the mods though....
