Well i am still waiting for my money, the Bank of Scotland offered me the correct amount in writing dated the 20th April 2007, and telling me it would be in my account within 14days,

I have now waited since the 16th january 2007 for my refund, even though they have offered me the correct amount can i still start the court action as they have not paid in the agreed time.

I have all the paperwork ready and waiting if i can still go for the court action.

Try phoning the person who sent the letter saying they were paying you and warn them you have not been paid and if not paid by--- days you will go ahead with the court actionm and it will cost more. They should pay you right away. I am just off to court against CITI which has been going on since Nov.

I spoke to them two weeks ago on the phone and they agreed to pay me in 14 days then sent out the letter stating the same, the 14 days is up today and i am fed up up waiting, do you think if i have not been paid by monday i could start court action as they are being unreasonable stating one thing and then not carrying it through, i am sick of them, not long ago they were noisying me up about having my amounts wrong but i proved them wrong and they then agreed to pay in full....

I would give them one more chance. Write to the person who signed the letter at the address the letter came from. Tell them they have seven days to get the balance to you. You can state the amount they owe you, or you will start court proceedings and it will cost them more. I would send the letter rec.dely. Best of luck
