The 40 days starts from the day they got your cheque, which you can consider would have been the day after posting if sent first class. Use the waiting time reading up on what you need to do when you get the information.

Maybe a quick letter reminding them that their 40 days are almost up might help. They have been inundated with requests so are failing to send out statements within the 40 day time limit.

Thanks for the advice, although it was too close to the deadline.

 

UPDATE

Received partial information this morning, statements from the last year only, with a poorly photocopied note that further information will follow, but no date - standard stuff....Boy they must be inundated.

 

So I will show them the same consideration they showed me when I was made redundant - zero.....

 

Sending a LBA today for the non-compliance of the SAR with a further 7 days to comply. Incidentally, the charges mount up to nearly £1000 for the period they supplied statements for, I expect the total claim will be around the £5K mark.....

 

I might just start my claim now for this amount and submit a separate claim for the rest when the information arrives - any views anyone??

Hi lancslad I had similar from halifax 40 days sent letter of none compliance and prelim for the years 2005/2007 (downloaded from internet banking) with letter amended to say would amend to include 2001/2005 charges when they arrived or if claim settled then would claim again for tese years. they settled full claim Wednesday just waiting for cash in bank.

You could phone their Code compliance officer and complain. As Data protection is included in their banking code and every bank that complies to 'The banking code' has to have a compliance officer, you could phone them up asking to speak to the compliance officer and tell them your problem then they will actually force 'themselves' to comply.

 

I did this myself and within a couple of days I had all my data and and an apology from them.

 

Some might say that you should do it legally and thats a fair comment its just I wanted my details ASAP and I found this was the quickest way.

I would keep the pressure up on them regarding compliance with your SAR, so send them a LBA and complain to the ICO . Looking at other threads i would think you will have your statements in the next few days, so i wouldn't start a claim with the statements you have as it won't hurt to wait a few days, also since the Whistleblower programme you might want to use S 32 of the limitations act and go back to the start of your account with YB if you did open it more than 6 years ago.

I agree with moss to a point regarding keeping up pressure, but you can always amend your claim up until the time you start your court claim. So you could do a prelim now with the schedule so far, possibly adding that you expect more charges on your schedule once they have complied with the SAR. You can amend your schedule for the LBA if you have them then, or even for your court claim. At least it sets the ball rolling.

And now just sent LBA2 after receiving the usual "get lost" letter and helpful(!) complaint leaflet.....

 

Once I have this one settled I'm going back past the six years - there was one period about 8 years ago when I was made redundant and they took me to the cleaners....

 

Going to have a read on the forum and see what is the best / cheapest way of getting statements this far back.....:-D

Last week I requested bank statements from account formation date to December 2000 (ive already got 2001-2007 period) I just paid £10.00 and they have acknowledged receipt and say they will supply me as requested.

Did you only ask for 6 years in your first SAR? If not and you sent the standard SAR off this site you should get information back to when you opened your account.

 

Read the info in the stickys on this forum and I think you'll see there's no need to limit yourself to just claiming 6 years charges.
