    • thread title updated moved to overseas debt forum. sadly as they are outside any UK jurisdiction upon DCA rules which state in the UK they must not call employers, there not alot you can do to stop these scammers. make sure you totally make private ALL social media twitter/facebook/linked in etc etc as there no-way for them to findout where you work otherwise so you must have a leak somewhere. find it. your employer details arent even legally available to UK DCA's so how have they found it out to date???  simply write to the BANK informing them of your correct and current address ALWAYS!!. if you want to arrange payment or not TO THE BANK ONLY thats upto you. never ever ignore a Statutory Demand a Letter Of Claim a Court Claimform. if if if any of those ever happen. till then ignore and rewash. dx

    • Hello All,  I’m hoping someone can help me urgently here. Firstly, I’d like to say I have read multiple other threads and have some what an idea of what I should be doing, however my case might be slightly different so coming with my own questions here.    my situation is I lived in Dubai and had a credit card and a loan, loan with HSBC and credit card with Emirates (or the other way round), I lost my job and was forced to leave the country as I was staying in the country on my companies visa.    since coming back, after a few years 2 different debt collections agencies have been approaching me (one being IDRW and the other J&P). I’ve never answered IDRWW and they constantly chase me by calling and messaging me and my employer. My current company is ok with this as I explained the situation but I’m soon to be joining a new company who definitely won’t be ok with being messaged and called. I’m afraid to continue to ignore them as they may message and calm the new employer as they have before and I’ll lose my job. However, it seems clear from these forums that dealing with the debt collection agencies is never a good idea. You shouldn’t agree to the amount or pay anything.    j&p caught me on my phone but I still haven't sent them any money or confirmed the amount they’re saying is owed, they keep pushing to pay off the “principal” amount by making monthly payments, from reading these forums it seems like if I make one of those payments (they have provided bank details for ENBD), then it’ll just be paying off interest and not actually clearing the principle debt and the bank won’t even approve receipt of payment or that it’s coming off principle.    this is my predicament as ignoring them might not be an option if they chase my new employer. Maybe there’s a way to ensure the debt collection agency don’t contact my new employer?? I don’t know? Massively appreciate peoples help here. Thanks,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

help please i am trying to find any info on yesterdays happenings. Just got to school this morning to be told by other mums about a bank actually winning, sorry been at work so not seen any news, and i am frantically trying to find any threads relating to this

Hi Muggles,

 

Stop worrying. Dar£n has been investigating and it seems that the person involved had not followed correct procedures, and therefore he lost, provided you follow all the advise on here you will be fine, have a look at other threads on this site, as it has been explained to a few people now.

 

It will be fine if you follow proceedures.

This case was a mixture of misfortunes including a judge that wasnt really interested in supporting consumers. prob some ole fart who still works in shillings etc.

Lloyds didnt turn up for the hearing prob because even they didnt think they would win.

This could give the banks a little confidence, but what if they get a judge that hasnt got tunnel vision? or has already been messed about by them with previous claims ? will they take that chance? I dont think so.

Another aspect of this recent case was that the decision was made by the a Distract Judge. Such a decision does not set a precedent for future cases, and other judges are not obliged to refer to the decision. I would support what has already been said above - if you follow the step-by-step advice on this site, you shouldn't go wrong.

to phone or not to phone that is the question..... its now been 17 days since i had my letter of transfer and barclays defence. Do call the court to see what happening, is there somthing i have missed or contunue to sit tight..

thanx michael,i have just been reading lateralus "new after 28 days no aq "thread, and on there it says still have to pay the £100 within 14 days after transfer to the court even though no aq (i have had no correspondece to say what to do,) i will give the court aring tommorrow panicking a bit now in case i have missed this n it gets thrown out ii realise this is a new tack and will keep you and others informed how n whats happening. kicking myself was gonna call on day 14, didnt wanna seam to pushy.

I recieved notification from the courts today, that i had to send in the £100 even though the AQ had been dispensed with, this is about 7 days since the transfer to my local court.

I would phone them first thing tomorrow and find out what to do.

thanx caz, it will be just my luck to have missed a deadline cos of royal snail n all this worry n work be for nothing, when i called the local court after first recieving my letter of transfer she was really nice but she said it was relatively new to them and they were having teething problems with it, typical

just called my local court, ur all right they are really friendly and helpful. They have just told me that yes i will have to pay the £100 and there is a letter in the post which was sent by them on friday, so should get it this week its for 20 th august, great just when i got my holidays booked !! , so im gonna give barclays a call today when i get back from work to give them a chance to settle, anyone out there know who is the best to call and any phone numbers please, wold be really gratefull, im still on track but getting a bit gittery again. thanx in advance.

Yep Muggles excep my court date is for 28th June, so a little ahead of yoI have your back, go for it, let me know if you get through, i have phoned about 4 times today just keep getting answer machine.. GOod luck

wahooooooo....... (steady calm down !!!!), just come off the phone to krysta ( hey she really nice too dont know what i was worrying about ) got straight through first call, (sorry caz), told her i had recieved my court date ( it hasnt come in the post yet but court told me it was on its way), asked if she would like to settle out of court and she said yes we will definately be settling before it goes to court, yippee thought i... now here it comes, she cant do it today she has to get the figures verified by the accounts dept but could she take a contact phone number and give me a call with the settlement figure, i pressed her on how long that would take as i have been more than patient enough and she said she would call on thurs, i told her that i am in a medical meeting on thurs she said it would probably be wed then, if not to call her back on friday if i havn't heard anything as she is really snowed under at the moment ( you dont say wonder why that is !!!! ), any way keep ya posted. thanks again caz hope you get through to her soon, when is your court date?:p:):-D

ps this medical meeting i am in is only a first aid course but it made me sound intelligent... HEHEHE

Hi Muggles, Right race is defently on!!!!!!!!! You made me determined so i gave up phoning my contact and eventually got through to Krysta, i figured if you had just got through she must be answering. Success i spoke to her, she said she was sure they would like to settle, i also blagged it a little, but she has passed my phone number onto Kate and has asked her to get back to me today, (she probably wont, they never do), so if she hasnt got back to me by tomorrow afternoon i will phone her, HOW exciting is this,,,,,,,,, who will win,,,,,,, who will deal first,,,,,,, So muggles its just you and me who will cross the finishing line first.................................!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

MUGGLES i am so excited i have just had a phone call from Kate and she has agreed to settle, she is waiting for the figures from accounts and a letter with the settlement figure will be in the post and i will have it by friday.

So who will get the money first!!!!!!!!!!!!!!!!!!!!
