      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thank you Barty...I have now collated and prepared my 85 page document to send to Lloyds TSB and the Court. I am very pleased with it I have to say, looks very professional!

I have one question.

Did you write a covering letter with the papers? as I need to make sure I get the £220 court fees returned.

Morning all

Well I posted all my court papers off on Wednesday of last week (4 April)to the local court and to Lloyds Bank.

I shall now sit and wait to see what happens. I guess it is just a waiting game now until 14 June 2007.

Hi all just to report I have heard nothing from the bank as of today's date.

I rang the court just to confirm they had received my paperwork and they had so this waiting game is getting very dull now.

Hopefully I will update you soon with some better news

Has anybody managed to push Lloyds into passing their money over sooner than just waiting to hear from them prior to the court date.

I was just wondering if anyone had used any tactics or know where to call to check they have received the paperwork etc....

Just a thought, do excuse my itchy feet and anxiety.

Well, it is the 8 June 2007.

I am due in court on Thursday 14 June and I wasn't expecting to hear anything from Lloyds TSB until then.

However, this morning I open my post - the envelope is marked Lloyds, I got terribly excited thinking it might be them offering me a settlement.

But no, it wasn't it was a letter stating:

 

Thank you for your letter dated 20 February 2007. I am sorry that you've not been happy withour response so far.

I am unable to add to our letter dated 12 February 2007. This is because we have already outlined our position on the points you have raised.

I can see that you have already issued a court claim for repayment of these fees and that our solicitors are dealing with it. If you are successful in your claim, this figure will be deducted from any award that may be made. Other than this, we will not be making any attempt to reclaim this money.

Thank you once again for taking the time to raise your concerns with us.

I shall hopefully be reporting back next week with another success story...I do have some niggling bad feelings about it though!

I am currently filing a case against TSB but am worried cause I seem to be stuck in a stale mate situation. Lloyds transferred the case to Brighton Court, which is miles away from my home, I was issued with a Notice of Transfer of Proceedings but it said that

1. Orginally I filed throught Northampton Court who sent a letter saying 'The filing of an allocation questionnaire will be dispensed with in this case unless the District Judge at the court transfer orders otherwise'.

I have been waiting a month for a court date from Brighton Court, and they now say they have a big backlog and will may be another two months before this can be done. Can I speed this up or ask for it to be transfered to another court. Also I am worried over the formums all seem to talk about the allocation of a questionnaire. Why do we not appear to have had one ? Can any one help ???

If you check earlier in my thread back (page 1)to 6 March ish...there is a really useful link by Barty to help re: allocation questionnaire.

You only receive an allocation questionnaire when you have a court date I think, well I think that is what happened to me...and I also believe you can ask for a different court, it should have the details on the original form from Northampton telling you which court you were going to be going to, I think there was a section which said if you wanted to change your local court.

HELP!

I was hoping to have received a cheque through the post this morning from Lloyds as my court date is tomorrow.

I received nothing and my appointment is at 10.00am.

I guess I just turn up and hope that Lloyds don't?

Have you seen the message GaryH has posted asking if people haven't heard anything from Lloyds three days before they are due to go to Court to let him know??? I can see myself in the same situation as you - our Court date is 28th June :roll::!:

 

Good Luck for tomorrow anyway - fingers crossed for you. If you have online banking check your account!

I have just double checked my court papers and it says:

Signed statements setting out the evidence of all witnesses on whom each party intends to rely shall be prepared and copies included in the documents mentioned at (a). This includes the evidence of the parties themselves and of any other witnesses whether or not the witnesses are going to come to Court to give evidence.

I dont need that right?

Well it is the morning of the court case and still nothing in my bank account and nothing in the post.

I shall be setting off shortly to the court and will report back my judgement later.

Good Luck, Kitty. Not what we wanted to hear but I shall be thinking of you and waiting to see what happens. Remember to take a notebook & pen with you just in case you need to jot anything down. This is the nightmare scenario none of us want. Fingers crossed eh??

Just realised I should have papers etc from SC&M today - the deadline 14 days before hand.

Hi everyone

I have just literally got back from court and I have very good news.

The LloydsTSB representative was there waiting for me which really put me on edge...however, she met with me outside the court to offer me full settlement of my claim plus the £220 court fees.

We then went into court, (there were about 20 people all in all, in the court being heard at the same time). Basically they had a list of people reclaiming their bank charges from First Direct, RBS, Nationwide, Barclays and Lloyds and all 20 of us entered the court room together.

The Lloyds representative then informed the judge that we had agreed to a settlement. She then had to go draw up what we had agreed which was £3,461.02 plus £220 court fees on a piece of paper.

The judge then ruled that he was happy with this and informed us that we will be receiving an 'order' from the court in due course in my favour.

I was then informed that I should expect to get the money within 28 days!

A very long and scarey process, but I am so thrilled at the outcome and thrilled that I was given support so much through this site that I had the confidence to turn up to court and present my case.

Thank you all so much for your support and wishes of luck, I hope this inspires many others to continue with this process, especially Amber Ellie, I am sure the same thing will happen with your case.

I shall report back when I actually receive the funds into my account.

great news even if you had to go all the way to court.

Seems the usual that they settle in full on the day of court and before going in.

Still waiting to hear about my court date against Lloyds after they defended.

HA! it sure did drop, it was so awful! however, that feeling didnt last long and the representatives acting on behalf of the banks were all really nice actually so there was nothing to be scared of ....

Thanks for the comments, and I wish you all the luck in getting your money back, I would be interested to be kept updated by you all and will keep my fingers crossed for each of your cases!

You are an inspiration - I have been putting my claim off for ages (just a big puff!!!) You have inspired me to get my backside into gear!! My claim is just under £5000!!

 

Can I just ask you a quick question - when you first put in your claim to the court did you add the statutory interest and if so had you already inlcuded it in the schedule of charges you sent to the bank?
