I think i am ready now to post off my court bundle for a court date of 13th april. I just wanted to check if there was anything else to do.

 

do i need to put a covering letter with the court bundles?

 

Do i put an up to date spreadsheet in the bundle?

 

What address at barclays do i post the bundle to, and should i write my account number on the front?

 

Should i ring someone at barclays and try and get them to settle before i send the bundle.

 

I think thats it, i just want to make sure i get it right.

Yes, best to put 'SiFly V Barclays claim # xxxx with hearing date details

Barclays Litigation Team addy...addressed to the person who's handling your claim, no need for account number on front

 

Should i ring someone at barclays and try and get them to settle before i send the bundle.

 

Not really much point...they will only settle when they are ready, but will leave it to the last minute in the hope that you give up!

I think thats it, i just want to make sure i get it right.

Ive been thinking (probably a dangerous thing), but are you sure i put the latest spreadsheet in the bundle because isnt the interest worked out on a daily basis from the date that i filed for court. Sorry to be a pain, but i am really hoping that i dont screw this up now

Interest does not get added to the spreadsheet pre-court unless you are claiming contractual.

It makes no difference anyway since the you will continue to acrue interest until the claim is settled.So sending an old charges schedule will suffice (the one you have supplied in the past)

As a general rule the SOC to Barclays will not include the 8% until ready to go to court, but the interest is still calculated from the date the charge was imposed.

I made the mistake of forwarding my SOC showing the 8% but so far hasnt made any difference its been included in my MCOL file.

so are you saying that i shouldnt include the interest charges column and just let the court work it out based on the daily amount that they are already aware of in the particular of claims.

Si, I don't know if the confusion has arisen because you are already at court bundle stage rather than at the 'filing your court claim stage. In your latest schedule of charges, you can add daily interest up to date, but it isn't overly necessary, as the bank is already aware of the daily rate of accruing interest. When they call to settle, just make sure you have your figures at hand, because often in the excitement of things, people forget to ask for daily interest up-to-date, court and allocation fees etc (if applicable).

 

For what it's worth, in my bundle I just added an extra row to say daily accruing interest to date at xx pence per day = £34 (e.g.)
