      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

A small point, but- we are actually dealing with three organisations.

Halifax, BOS and HBOS.

 

Shouldn't matter about the cheque though once it's cashed they are culpable.

 

Just thought I would point that out because I've got nothing better to do today!!!!!

Hi there:)

Had a call from Halifax offering £240 short of my £2300 claim(excl. interest)which I asked him to go and check because our figures didnt agree.I asked him to call me back today once he had checked which he said he would.

 

(BTW I had claimed 6 years not 5 as should be in Scotland! )

 

Now having doubts as to whether i should have accepted the offered amount as this would have been the 5 year amount.

Hello

Just had a call from Halifax offering £240 short of £2300claim. (excl interest) which i haven't quite accepted as the basis of the call was :

1. To let me know that they didnt have details before 2003!!!!

2. to give me an offer.

I said no probs I had all the statements we could go over them on the phone,he said it was ok he would look into it. I asked him to call me back today which he said he would...........

 

BTW........ I had asked for 6 years not 5 as should be in Scotland!!The amount offered is nearly the 5 year total.

Thinking now i should have accepted!

Hi change-it and i see your LBA is up in the next couple of days, if you raise a small claim you will be entitled to judicial interest of 8%, you can do this if they dont offer you the full amount you have claimed, when they know you have raised an action against them they will settle over the phone with the interest, does the 8% make a difference to the size of your claim. This is not being greedy this is them trying to avoid the extra costs and yes at the very last minute also, so i would do them no favours, one more week they would have been served with the claim and would need to settle for charges, interest and costs. Good luck with your choice.

My sentiments exactly but would I need to reduce claim to 5 years then?

My thinking is I'd probably need to claim thro' FOS too ?(as claim is £2300)

Thanks Looks like it will be soon! yippee altho ive got a huge overdraft to clear!!!so wont see much of it.:( But it will be great to be in the black again!!(well sort of!)

In scotland we can only claim up to £750 or £1500 in small claims court so not as good as £5000 in England!

Well my time has come to say:

 

YIPPPEEEE I WON :D

Phone call this morning (8.40!!!! are they keen to give me money or wot!!)to offer FULL amount. Didnt take long to 'find' the other statements and 'manually' add them up from after 6pm last night......sarcasm ....sarcasm....

However said am gonna continue claim until money received, 14 days he says....watch this space...

Nice one change-it least the balls rolling on your case and they've nearly offered the full amount. very tempting offer but you done well knocking them back, keep going you will get the full amount. will keep an eye on how your case goes by the way, as its very close on for same as mine. get tore into them for your cash!!!
