      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ooooooh......... 12. My daughter stopped talking to me (near enought) at 12. We had a theory that she'd been kidnapped by aliens - cos she acted like one for years!!! She's almost back to normal now that she's 18 though. Not fully, just nearly!!!!!!!!!!! xxxxxxxxxxxx :p

 

 

My eldest was the same, she was 20 last week and really quite human now, but she definately forgot how to smile for quite a few years !!! She didn't go to her prom, had other things to do (somethings best left unsaid!!!) My son, who was 18 last week too, had his prom, I cried buckets !!!! He was a typical lad though and stayed "cool" throughout... The hotel where they have the prom has a large car park, and Mums usually go down there to take photos of them all arriving, I used to be the school cook from his primary school, and so badly wanted to go there, to see him arrive as well as all his mates.... little wotnot would not let me, then said afterwards that I could have gone cos loads of other Mums were there!!! He arrived in an Aston Martin (obviously not mine) and look sooooo gorgeous. My baby is raring to go, like you say Fendy doing all her GCSE's now, think they finish at the end of next week, and I cannot wait to see her in the dress and all..... although typical girlie that she is, she tried on the dress about 6 weeks ago, and I think has now lost about three quarters of a stone, so possibly the dress will have to be changed. It's lilac, sequined and boned bodice, a sheer shawl, and full skirt.... Sleeping beauty could have danced in it at the end of the film!!!! I am so proud and teary about it!!!! and she is going to let me be there to see her arrive !!!!!!

Totally agree with all of you - it's been a fab afternoon, even though we've been dealing with 'issues' and stuff! And fend - yer little rhyme........... brilliant! And hubby thought so too!!!

 

Okie dokie - dinner nearly ready to dish up, and I've been nipping back and forth to the pc to knock up ma' rejection letter! Could peeps have a look and see what they think please?

 

Response to settlement offer.

 

Dear Mr. Higley,

 

Thank you for your letter dated 22nd May 2007 offering me a refund of bank charges applied to my Nat West current account at a total of £1,136.00.

You may not be aware that I commenced legal action against you for the full amount plus interest and court costs on 15th May 2007. This claim was deemed to be served on Nat West on 18th May 2007. Therefore, I respectfully decline your offer of Full and Final settlement as this does not include the additional amount of £120 which is the fee I paid to file this claim in the Salford County Court.

If you wish to settle this matter in full, I am quite willing to accept the full refund of charges plus the court filing fee of £120 as a full and final settlement. Total of £1,256.00.

 

I would ask that, if you are unwilling to settle for the above amount, you now refer this matter to your legal department for further instruction.

 

I trust this clarifies my position.

I shall see what I can do, have looked at him's schedule and he's working that weekend. What sor of time are we looking at? cos he's on days that weekend and that means 6am til 6pm, and also means early nights!

I honestly don't know, but I'm hoping for an early start early finish personally. If there are a few though it may go on ages who knows, I think we'll have a better idea nearer the time and have a proper head count.

can't even wear them bloody thongy shoes, what they called, had a pair for benidorm only wore em once, they nearly sliced me big toe off and if you lose your big toe, apparantly you lose your balance:eek: so i weren't drunk really:D :D
