    • thread title updated moved to overseas debt forum. sadly as they are outside any UK jurisdiction upon DCA rules which state in the UK they must not call employers, there not alot you can do to stop these scammers. make sure you totally make private ALL social media twitter/facebook/linked in etc etc as there no-way for them to findout where you work otherwise so you must have a leak somewhere. find it. your employer details arent even legally available to UK DCA's so how have they found it out to date???  simply write to the BANK informing them of your correct and current address ALWAYS!!. if you want to arrange payment or not TO THE BANK ONLY thats upto you. never ever ignore a Statutory Demand a Letter Of Claim a Court Claimform. if if if any of those ever happen. till then ignore and rewash. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello need some help and advice I have an Adverse mortgage with Birmingham Midshires on my property valued at approx £182,000 by Kensington Mortgages when they gave me a secured loan, for £27,000 which has now gone upto £30,000 with charges and late payments. I didn't receive a letter with a court date from them and today I have come home to a Eviction notice for the 01/03/07 12pm saying we have to leave and take all our belongings by then. I also have a possession order for Birmingham Midshires for the 20th March 2007.

 

We have got into a mess due to me changinge jobs and being out of work for a few weeks and my hubby is back in work after being off sick for 13 weeks with gout. Yes we have buried our heads in the sand simply because they would do nothing for us. I am going to put the house on the market but do not wish to get evicted as we will never get the market value for the house and end up owing thousands. I have a 7 yr old boy and it will mean we will be homeless please help

Go and see a solicitor ASAP to get the eviction stopped. With that much equity it is mad that it has gotten to this stage. Tell the solicitor you never got info about the hearing.

 

For something this serious and such a short deadline I would suggest getting good legal advice from a solicitor and having them deal with it as imperative to stop the process.

 

At the very least go to the court in person and tell them you didn't get the documents from the court and they should give you something to complete to try and stop it.

Hi thanks for the reply!

 

I called the solicitor acting for Kensington they advised that I had a suspended possession order from 2005 and that is why I didn't get court papers!!

 

I called Kensington to offer them £800 now and then said that I would pay an extra £100 on top of the £324 per month I owe them they then said that the want the full amount of £1,597 plus my payment is due on the 1st of March the same day of the eviction notice and i would have to pay that also!

 

So I am now going to seek out a solicitor and go to the court myself to see if I can talk to a Judge to explain that effectively they wish to evict me and my family for £800 What a Load of Money Grabing Bath Plugs!!!!!

 

The woman at Kensington seemed almost excited to evict another family almost as though she is on commission!

 

Th worst part is that since 2005 I have been paying a penalty of £50 per month which adds up to £1,200 I could cry but I need to keep composed

get an n244 off to the court stating that you would pay the monthly payment + that amount of the arrears, give them a copy of your financial statement and also quote cheltenham & gloucester v norgan (this case law states that a reasonable amount of time to clear the arrears is the remainder of the mortgage term).

 

give cccs or national debtline a call right away.
