      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

:D Well.. this cannot be resisted I will be honest, after all it is hard earned - by us all!!?... So, although I have SAR prepared, I have also read in various emails that some members have also just telephoned the bank, and list of charges has been sent.. seems really simple?...but will give it a try if it will make things move quickly, and then if no success I will send my letter next week, and in the meantime continue perusing all the FAQ, as there is seriously good data there ...what do you think?

:confused: Just an update... still waiting patiently and counting...but reading daily - any advice much appreciated at all times please keep an eye on me???

 

Have noticed from some statements that I have in the house that there can be various charges ... where does the line draw, ie. is it the £30 late fee only reclaimable..or is it also the paid DD or debit card fee reclaimable?? I also notice they charge interest...surely that is not reclaimable, as that would be due to my "mistake"??

 

Any advice much appreciated as want to move on this as soon as I get statements in...

 

Thank you - please let me know if I am doing this Thread/email to forum correctly, as had no response on last email - I think??

Yes your thread is fine...;)

 

 

You can claim for every charge.

 

The little monthly charges (£2 ish) you have to be able to prove that you recieved those due to the charges.

It can get complicated, so most people dont bother.

Yeah, I agree with Sea-Side on that one. I started working mine out and gave up! It would have probably added another £150, but I just though sod it...my brain was starting to hurt (easily done!)

Thank you both for replying - today I have received huge nos of envelopes from Halifax...so will be working through them, wary still on what I can claim back mind you, as don't want to do anything I shouldn't...please watch this space as will have more queries I just know it!!

Just an update:

They are there every single one of them!!

 

All statements in 7 days - Rec'd on 7th Day 12th March - I paid £5 per account - after making a telephone call to Halifax requesting them!

 

I am amazed...especially reading how much trouble some others have suffered waiting to receive them!

 

I would totally recommend the way I requested the statements.

 

Now...to the charges...and boy am I confused on that one...but be back in touch for advice...please!

Make sure you check them at least twice as its easy to miss a few.

Once you have done that, then put them onto the spread sheets. Use the one on here. Its on the list jos has given you.

Thanks Sea-side Lady - have been reading loads of your responses so much appreciate your help & guidance!!

 

I will be reading through FAQ once again to make sure I am on right track...but it is the Charges I query - Halifax ususally state £X Charges as notified, and then charge £x debit interest also - but I only go for the Charges...I am right, aren't I??

 

Tally all these up on spreadsheet, and as unable to specify what charges were for, just state charges - but leave off the interest of 8% till a later time...if nec.

 

It is just the Halifax is such a large org...I do not want to get this wrong..so apologies for my nerves..!!

You have got the idea.

 

On the spread sheet just put charges as notified.

And yes all charges, the little ones are hard to work out as you have to prove the amounts, it can be done but is complicated.

 

And the interest added at the court stage. But you already knew all this. I know what you mean about being reassured so you know you arnt making any mistakes. Any worries just shout. :D

Thank you so much!! I think the reassurance is the vital factor in this Group, as without that the "alone" bit makes it all the more scary for the ordinary person - like myself - to take on such a task!!

 

Anyway - prelim letter now typed...yes I have been avoiding tallying.. in truth I dread to think???

One query on that...the red sections of the letter - did you check your credit reference before sending the prelim letter onto the Bank with schedule, or simply omitted or included the section?

 

I have never remembered a letter advising me of a default on Credit ref...surely they cannot do so without advising customers..or can they?

I have done my spread sheet - and prelim letter - over £2000 - what I could have done (and do!!??)) with that with a growing family!

 

So, all being well letter will go tomorrow and 14 days commences - however I think fresh eye & major re-check over spreadsheet is a must first ..!!

Just my luck - been checking the Royal Mail Track & Trace - & guess what letter has not get there yet...and week only remaining...so I send another prelim letter or do I leave...and wait & see?? Post office said it may have got there but will not confirm it as lost until the 2nd. Advised me that I should have send it special delivery for guaranted peace of mind - oh why me???

 

Help & advice anyone please!!!!

 

There was I waiting for the 14day end on 28th of the month, and now I may have to start from scratch on prelim... advice really required!!

Hi re your lost letter.

I would knock out another one sharpish. Put something in it like not having received a receipt for previous letter here is another one just in case and you are going to be a great person because you're are now giving them another seven days.

That covers all points.

They have a letter,

you can trace it,

you are reasonable in giving them more time,

your only seven days further back.

 

Of course if you do get notice of your original being delivered - sod them and screw them for every penny!

Yeah, I keep thinking all the returned charges will totally clear my default on the accounts, then other days I KNOW I'll be the test case that ends up in court, but I guess everyone feels the same. We'll just have to keep each other's chins up!

Guys...I received an acknowledgement letter from the Halifax...saying blah blah 8 weeks to investigate and respond to complaints, etc...and so today is the day 14 days is up - it is now LBA time!! Woh, am I nervous... how is everyone else doing???

Get that LBA in the post pronto, then you can become one of the many success stories. It's easy to say don't be nervous, but you're going down a well worn path and everyone seems so helpful so GO GIRL:p

Hi guys - yes I am on target..my LBA went on 28th March with schedule of costs (again!) - so the 14 days on that is due up on 11th April by my reckoning...so what I can say??? Perhaps watch this space, but really if I am honest my imagination is running riots, I am just trying to remain calm & collected about it all, if that is poss??

Do keep in touch all of you as support is so important in numbers, hey??
