      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

For those who have been fined/billed/invoiced (or what ever they call it now) by UKPC and then been threatened by UKsearch this is what comes after.........

just had a letter from Incasso, who state they are SOLICITORS - (why do they feel the need to put that word in bold caps? maybe they thought I'd be intimidated) in relation to UKPC's unpaid monies.

They have said that if i don't pay in 10 days they may (not will) take legal actions.

not even going to reply, will not be paying. If a court summons ever arrives I will let you know. Until then I will not be losing any sleep over it.

Just interested how long has yours bin going on for, how many letters, and how much are they trying to [problem] out of you.

 

they sent me 3 - 2 from ukpc and 1 from a dca so far and trying to [problem] £141. at the mo.

since April, about the same amount from UKPC, made the mistake of answering to begin with which only encourages them.

3-4 from UKSEARCH, even though i wrote back to say payment was in dispute and to refer back to UKPC, so waste of stamp if you intend to go down that route.

waiting for the same amount from this lot.

for those who are worried think about the amount of serious offences that are lost in court based on a technicality. Do you think these parking companies are bright enough to ensure all loopholes are covered, if that was the case we would all be in court!

Me so far.

 

Had 2 from UKPC since the 19th july 09 i now have my 3rd letter from a DCA called Debt Recoveries Plus LTD. phone no 0844 561 0965. does anyone no of these muppets. they seem to have gone straight to ITENDED LITIGATION and court stage unless i pay the fee of now £141.75 within 10 days. saying they will give ccj and the like, its been since the so called offence the 9th july.09.

im not gonna pay it at all.

I never have contacted them atall and im not gonna...:-D

You need a court hearing to be issued with a CCJ so they are bluffing. good for you not being intimidated by these [problematic]

The purpose of a County Court Claim

 

Someone you owe money to (a 'creditor') can take a County Court action against you to claim the money. If you pay the amount outstanding, you can avoid a hearing or judgment. If not, there'll be a simple court hearing in private. You can attend if you wish, or just send the information the court asks for by post.

The court doesn't find anyone 'guilty' or 'innocent'. It looks at the facts and decides whether you owe any money, and if so, how you should repay it.

Under Scottish law claims are dealt with differently, by the Sheriff Court.

 

County Court Judgments (CCJs)

 

After the court hearing, the court may issue an order saying you must repay the debt. This order is called a CCJ and will either be for the amount agreed between you and your creditor or, if you can't agree, a payment set by the court.

If you have judgments from more than one creditor, the court can combine your debts and make an 'administration order' - saying you must make a single payment every month to be shared by all your creditors.

 

 

 

Therefore my advice would be wait for the summons (which i doubt will ever come) and if it does you can always agree to settle before the hearing.

doesn't matter where you got the ticket the respnse from them is the same. remember these companies also scan this site so keep dates/times/places/personal info to a minimum unless you want to assist them building a case against you.

hi 2onlyme2. i did not say id got a ticket, i would not pay if i did. im just interested if any one on here as recived a ticket whilst shopping at merry in dudley and if so how long its been going on.

The clue is actually in all the letters they send, if they believed they had a cats in hell of a chance at court, you would only get 1 letter then if ignored they would be straight to court, no ifs no buts.

Or you could fight the case with a very good chance of winning and pay nothing;)

Hi m3rzs,

 

I got mine at Merry Hill, Dudley at the end of November last year and it's still going on. The collection of letters is getting quite thick. However, the debt recovery company changed part-way through from Rossendales to Scotcall so I've had 2 lots of recovery people threatening me with litigation, visits, etc where most people will usually only get 1.

 

The car park there is not the best. Some areas have double yellow lines, some don't. I got my ticket when I parked in an area that wasn't double yellow lines but not a marked bay (it said I was causing an obstruction but you could've driven a juggernaut through there). When I saw the ticket on the car, I photographed the whole area to show the inconsistency with the double yellow lines but, after I read this forum, I never bothered to get in touch with anyone and just ignored everything.

 

Anyway, the last letter stated that they were passing it back to UKPC so I'm hoping that I'm only a couple of letters from the end.

hi cardboard man thanks for the reply keep up the good work. my boss recently had problems with ukpc at merry hill. he spoke to the appeals officer at dudley who was very obnoxsuois, he told her that all mail collections/del would be stopped if they continued to harras us. we dont get any tickets now, i told him to read this forum and judge for him self.

well in this instance it appears that you r not calm, 600+posts or not. u should make the point more understanding, anyone looking would think you were having a dig at me. i suggest you take another look at the post i oringaly posted.this was directed to the person who had recieved a ticket from merry hill. this just shows your pure ignorance and also that you got involved in some elses conversation that really did not have anything to do with you. to finsh therefore i suggest that you ask a grown up for clarification to ask if the conversation was involving you.. GROW UP

I'm afraid I'm with 'letshelp' on this one, he was definately referring to the supposed "appeals officer".

 

Can we continue the real thread here, which is ONE LONG conversation involving everybody who has an interest.

 

Who's had the most letters so far? I'm personally on 8 now I think.

Some good news. Tesco has arranged for the UKPC charge to be cancelled after I complained to Customer Services. I still don't think they should be using these cowboys, and said so, but I doubt it'll change things for everyone else. It may be worthwhile to write/email the store owners - if there's enough customer feedback, they might have second thoughts.

first of all no offence taken, however im not really bothered whos side anyone else is on. i am more than happy to carry on i did not take it as a joke but personal to me. but it now seems that others want to join in. like i say im more than happy to carry on.
