Hi all,

I have just recieved a response to my first letter to the halifax,it sounds like the standard letter that most people are getting, although there is absolutely no offer of any money,i am sending a further request before legal action but just wanted to check if this is ok?

thanks in advance

What does the letter say?

Are they just acknowledging your letter and telling you that you will hear from them in a week's time or so? That is what Halifax mostly does.

Halifax tends to send a letter of acknowledgement, then an offer which in most cases is not the full amount. All of this normally comes within the 14 day deadline that you give them in your preliminary letter. So to me, sending a LBA at this stage is a bit too early.

It would be interesting to see what others think.

Have a good read of the long Halifax posts to get an idea about how they operate before doing anything else...

17 November - Prelimanary letter

25 November - Confirmation of receipt from Halifax

29 November - letter from Halifax Goodwill gesture £318 out of £408 (original claim).

6 December - Rejection/LBA Letter sent

18 December Halifax letter offering £408

18 December - MCOL completed - claiming interest and costs £523

28 December - Won! Money in account!

  • 2 weeks later...

hi,sorry for delay in posts.

I recieved a letter back from my local branch last week saying the matter has now been sent to the customer relations department.

I am keen to move onto the court stage but in my L.B.A i gave them seven days which is up today, after reading numerous posts i think it would be wise to leave it for the full fourteen days, does anybody know if this makes any difference?

Hi

Your LBA should give the bank 14 days to reply. You must also allow enough time for the bank to receive it. After a full 14 days have expired then you have the option to issue Legal proceedings.

Read plenty of threads and don't rush things, this is a slow process.

Hope this helps.
