      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just to let you know,I emailed Krysta on friday and as yet no reply the same as the phone call

,I just said that I didn't know who was handling my claim therefore I didn;t know who to contact as regards a settlement.I wonder how long it will take to answer,I'ii leave it until wednesday and email her again,I think they are giving you the run around hoping you'll get fed up and go away but stick with it it's worth it in the end.

Once your claim is settled you can give them another kicking with the Wasted Costs claim ............... :D:D

Well the latest in the saga is as follows:

This morning I phoned and spoke to Paul Quinn, who advised that he receives over 700 call from claimants, I aksed if he had read my email, no was the answer!!!. No information had been sent from accounts !!!!!. and that the figures would need to be looked at, I stated that within our conversation last week he stated that Barclays were settling all claims 100% together with 8% Interest and court cost, Well, Mr Paul Quinn refuted this and stated that he would not have said this, he denied all knowledge of this conversation!!!!!, by this point I was hopping mad :mad:, I said he did state this and he said was I calling him a liar, and in not so many words he was CALLING me a liar, he then stated that if I had no further questions which he could give me an answer he was ending the call. And he did!!!!!

WELL I JUST WANTED TO BURST INTO TEARS I WAS SO :mad: :mad: :mad: . I had a cup of coffee to compose myself and thought right, i have not come this far to be spoken to like this, and to be told that I have made things up, so I called the main barclays switchboard to be put through to the person who heads the Litigation dept, went through to his temp PA and stated that I was making a formal complaint about Mr Paul Quinn and the way I am being treated re delays all the time. Her name was Emma Williamson, who was very nice and stated that she would get the head of dept to ring me back in 2 hours.

2 hrs later on the dot I was telephoned by a Robert Allen who could'nt apoligise enough. to cut a long story short and not to bore you, He stated the following:

Paul Quinn had been spoken too and he apoligised for his behaviour.

He went through the process of what data is needed. I did stress however that I have a letter from the Woolwich back in Feb which states that all corr and docs had been forwarded to Barclays.

He gave me his personal number 0207 1162709

He stated that I can call him at any time.!!!!!!!!!

He stated that he had personnally moved my claim on re settlement offer!!!!

He stated that with my permission a Robert Saunders will now take over the handling of my claim.

He stated that Robert will Call me personnelly before the letter is sent with final figures!!!. He stated that he was sorry and hopefully nothing will go wrong and that there would be no further delays!!!!!!!.

Lets hope he's right, I look forward to receiving a phone call and hope that Robert Saunders is a more pleasent person to deal with.

I did however state that I was prepared to swear under oath that all what has been stated in these conversation was indeed said!!!

So what started as a very bad day :mad: finished on a more brighter note ;)

On a serious note... Robert Saunders dealt with my claim and was brilliant, he is new, but did what he said he was gonna do, on time and without follow-up e-mails or phonecalls needed on my part. If only all legal clarks were as on-the-ball!

Hopefully your claim will run smoothly from now on in.

I contacted Robert by phone on the monday and by friday my settlement in full was in my Woolies account ready to draw (which i hasten to add that i did!! rather speedily!)

Hopefully I will now see some action, this has certainly been a roller coaster of a day. Robert Allen did state that I should receive a phone by friday let's just hope he keeps to his word. Had the carpet man round today measuring up, so they had better hurry up!!!!!!

Keep on, it's the only way we can get anywhere, after what happened today I would urge everyone who thinks they are getting the run around to keep on and not give up, give eveyone a call and keep trying every so often say half an hour, hopefully someone will pick up and you will find our who is dealing.

I have to say I chuckled, yes not very girly, but my real name is not very interesting and I couldnt think of anything else. Everything else I thought of had aleady been taken, even the Dog's name ROLO!!!!!!.

Of course I will keep on helping, hopefully someone else can learn of what to do and not to do from where I have gone right or wrong.

 

A holiday is booked in Turkey, taking my daughter for her 1st time abroad, she has had to wait 10 years while mummy and daddy fight to pay peter and take from paul whilst all the time trying to keep the bank sweet by making sure they had their charges paid, on the day they stated and at a time that suited them best, forget just trying to get by. rant over!!!!

 

Will keep you all informed of any settlement that comes my way this week!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!:p

Robert saunders is really nice, i emailed him and he reply within the hour, so he does answer u, havent actually spoke to him yet but in the emials he does sound nice, so hopefully you will have more luck with him.

Every single penny, yes every single penny, did I say every single penny!! :D

 

I can't contain myself any longer so here goes.

 

Settlement offer received for just under £16,000.00, I did mention £16,000.00 did'nt I. Every single penny, no quibbles, no buts. When Robert phoned I stated that I had to deduct £1K from my original claim as it would make my claim over the £15K and I could not efford the court cost at the time, Quess what they even added that in!!!!!!!!!!!!!!!!!!!!. I read the offer and immediately faxed back, I just can't bloody believe it everybody, good things never happen to me, well they bloody well do now.

I emailed Robert back and asked when do I get the money, He emailed me back by return ,he will advise accounts to get it paid by Friday. Did I mention Friday, oh yes I did, never mind.

You have no idea how this is going to change me and my family, no more debt, no more phone calls at work, no more worry :D .

 

How can I ever thank you all, if you had not all pulled me through the darkest of moments, especially yesturday, I would have given up at the 1st stage.

 

I can't believe my phone call actually prompted Barclays to pull their socks up around their waists. You have to follow my lead and phone and phone and phone and phone again.

 

Did I mention that I've WON, I still can't believe it. Turkey here we come. Am I the biggest win yet on the woolwich/barclays site, I don't know.

 

I've brought a bottle of champagne to celebrate, the cheap version may I add, I'll wait for the dosh and treat myself and my family to the real thing. Gosh and golly gosh, i've won.

Dare I say it God Bless barclays, and god bless me for having the guts to make that phonecall yesturday :D .

 

Let the good times roll.

 

A very, very, very happy (infact I could not be more happy) (except when I gave birth to my daughter, better say it or she'll have my guts for garters).

Yes it will be spent very wisely don't you worry, we moved into a new house last year, and have not been able to afford carpets on the stairs, (its a 3 storey) so that's first, I am going holiday shopping this weekend with my daughter, so I will be treating myself a bit, and we won't have to worry about the spending money on our hols!!. The rest is to pay all the loan sharkes off which we had to take out in the 1st place because of these huge charges, and the little that's left will put in savings (for how long, now thats a different matter!!!!!!;)

Wow Congratulations.This is assurance for all Barclays claimants.We have known all along that they only move at the last minute but to actually endorse it is quite clumsy of them.

I take delight in changing your thread title to won .......Krysta Campbell by the way is no soft touch I had the experience of this with my first Barclays claim.

Just remember.....she is being employed to do her job and is seen as ambitious as a high flyer.....cant really call her for that but pity she is not on the winning side !!

Well done!!! Have been following your thread closely, as I am claiming nearly £10k from the Woolwich and you've been an inspiration. I have received my transfer of proceedings and their defence today, and no AQ required, so awaiting court date now.

Your victory has really perked me up from feeling it's all getting on top of me to knowing I can soon be counting the cash!
