      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I think i will leave it till about 30 days then i will give them a quick phone call just to see how things are going. Iv noticed a few people get theirs a bit sooner with a call. Its worth a try.

Hi all, its been a while.

I am still waiting for my statements, but i got a letter today from HBOS, standard i think. Just saying they confirm copies of duplicate statements have been ordered and will be sent under seperate cover.

Sent by Ken Patton, he must be the busiest employee there...!

17 days till the 40 day deadline, but fingers crossed i will get them soon.;-)

hi i got my statements the two following days after i got that letter, so you should be getting them any day now. I have sent my first letter and they have till monday before i send my LBA so I think is 2 weeks i will preparing to go to court, good luck amd keep us posted, oh and be prepared at the shock of how much in charges you have paid!

oh glad you got them so quick, i had to go over mine then re go over them the next day, because there were a few that slipped through the first time, if you are at £800 in 3 months you are going to find loads!

I think you can make more than one claim. If it were me (and it will be) I would claim for the oldest, say 3 years, first and some time later (to avoid them being lumped together in court) claim for the rest. This way any further charges can be added into your MCOL or N1. Sally

i have 2 accounts, the first has just gone over by a couple of hundred , but the other is low, if i claim £5000 on 1 can i add the rest to the other account? Im not sure how tho. Im just doing spread sheets, (numb fingers!!)

I dont think you can add charges from one account to another, like the person above said i think your best bet would be to go for the oldest charges first then afterwards go for the newer ones, good luck!

i am going to look into that, i was just worried in case i could only claim once on the account, if i split it in half and send the first one then when its finished (and bills paid..!) i can send the second half. If this isnst the way i should do it i would be very grateful for any advice.

hmm it may be worth asking a mod for it, i had a look through FAQ's for you but can't see anything about claiming once. I am doing ok handing in my LBA tomo so 14 days till court is filed!

Yes, you can claim for the one account more than once. It just needs to be less than £5000 (without the interest - this is NOT counted as part of the claim. e.g. If your claim came to £4000 but over £5000 with the 8% interest the court would regard your claim as being for £4000. Have I made this clear?) When I get there I will probably claim to the end of whatever year so as not to confuse myself.

so what i will do is the first bank account the amount is £1157 with out interest, so i can send that in the morning, then if i split the other account in halfish and send for £2358, even if they do round it up it is still under the £5000, then if i win the claim i can reaply for the remaining £2767.

This sounds right i think, Sorry if i am being a pain but i dont want to risk losing 2 thousand.

Ok,

What i have done is, done my prelims, i did 1 for 1 account for £1157, and the other for 2989, so the total is still under the 5000. They are ready to go recorded delivery in the morning, so then tuesday will begin my 14 day countdown.

Go back and read Caro's comments on 07/11/06. If you lump the 1st account with the first figure of the 2nd account you will still be under the £5000 (without the 8% interest) so that should be allright then. I do have a cheek giving you advice when all I have achieved so far is a capitulation with just one letter to Halifax mortgage department. Useful for Xmas though.

 

At least you will /should have money for February which is a lean month for finances. Go get 'em girl:) Sally

Yeah, you're right and once I have to send my 1st LBA I am CERTAIN my brain will freeze and I will need someone to give me some encouragement. Just to get me in the mood I am going to 'phone the West Bromwich BS tomorrow 'cos they cashed my cheque 2 weeks ago. Where is my data? Wonder what they will say, and will I be professional or tongue-tied?

 

Have you got your paperwork in the post today?;) Once the 1st one is in the bag I expect it will be like riding a bike. Hummmmmm

I have posted them...! On my way now ;-) So i have done what i said, i even found a few threads where people have done the same as me and gone back to the same account, so im a lot more confident now.

I hope you give them what for when you phone them, just know what your going to say before you call. And take no messing from them.

Im not going to take any calls, dont want to fluster.

I got 2 letters from them today. Standard stuff, "sorry to learn you are unhappy with your charges" (No s**t sherlock..!!!) We are keen to deal quickly as possible. You will recieve a repy with in 4 weeks.

So LBA already to go, just have to wait till next tuesday to post it.

Hi everyone, Thanx 4 all the help so far. Im afraid im asking again...!

I am having a problem with the spread sheets. I did the first ones without the interest which were easy enough. But i was just redoing them to add on the interest. It wont add on. Maybe im having a dense moment. In the interest box it says

 

#VALUE! Not a number: 3-Dec_2006

 

In the column where it says interest there should be a number. There isnt one on mine. Any ideas where i have gone wrong??
