      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

OK - feel like we are getting into the final straight now. Spoke with the court this morning who explained that the letter was indicating if Barclays do not send in their own court bundle by the 24th (2 weeks before court date) they will be struck out and i will be awarded the claim.

 

Spoke to Barclays (Sharon Debaule (?) is dealing with my claim). She said that the accounts department were disputing my claim amount by roughly 50% and she would have to got through my statments herself. I told her my current figure and was told an offer letter would be in the post tomorrow.

 

Has this happened to anyone else - bit concerned that they are trying to dispute my figures to the tune of 1800 quid. Obviously i will only accept a full settlement at this stage but do not want B's to drag their heels anymore than they have done.

Thank you to everyone on the site who has helped. This money will make a big difference, although I will not believe it until I see it in the account. Will make my donation as soon as the money gets to me.

Remember don't stop anything with court until the funds have cleared, then you MUST inform the court in writing that you have settled and wish to discontinue.

Fantastic Crow, just red your thread. I am collating my court bundle now and read your top thread on this page about 'Statement of Evidence' this is the first time I hve heard of this, what is it? Do I need one and where do I get this from.

Cheers Jack, Have PMd you the SOE. Remember to put your own relevant info on it. Also remember to put Barclays T and C's. I have it in PDF which has to be photocopied up to A4 if needed.

Thanks Crow, have sorted the SOE out and printed it, it would be great if you could send me Barclays T and C also so I can print that off.

 

This is new to me, I thought I had my bundle just about ready until I read your thread about SOE and T and C.

 

Once I receive T and C my bundle should be ready to copy

Congratulations crowe, it seems like every 5 mins someone new's just won and received a full settlement. And it gives the rest of us the boost to keep up the struggle.

 

It seems crazy that they keep refuting claims and offering chump change and then paying in full. Their legal bill for all this messing about must be astronomical. Mind you, they can certainly afford it with all these illegal charges they've been taking.

 

Like JackG, I'm still learning and hadn't heard of this SOE, although I've downloaded Bookworm's Court Bundle. Do I need both?

 

Am in the London Mercantile Court this Fri and think I've missed all sorts of things. Have looked for the Barclays T&C's but can't find them. Can you send me a copy of your PDF version?

I can, its the Statement of evidence needed, you must edit it and put your own details in then print it off and include it in your bundle.

 

I just heard of it tonight. See my thread JackG. last page last post from Saintly1 (the saint!) let me know if you get stuck I will try and help

Adding all this to your bundles def. helps to negotiate a quicker settlement IMO.

Hi Crowe,

 

Make the amendments, initial them, take copy for your file and send back to B's.

 

Don't stop your claim until you've got the money in your a/c and tell B's you'll Discontinue ONLY when you have cleared funds.

well done crow nice one,have been reading your thread with great intrest,its been a great help in my case ,and trying to follow the same route as you have gone,i have just recived defence papers from Bs,and a notice of transfer from the court, would like some info from you now and then if you dont mind ,i have a thread started , once again well done Roxy:)
