      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone

I’m new to this forum however I’ve also had dealings with this clown outfit Excel

I parked in a car park in Wakefield, paid for a ticket and went about my business. 6 weeks later received a "Fine" for not having a ticket?? After my initial annoyance and looking for the ticket, I decided to look on the internet i found this site and all its useful advice about ignoring the fine and any letters etc...

I now have a full set of Excel, Graham White and Roxburgh letter all with different requests for money which have been filed away safely in the bin.

I have also had numerous calls from Graham White Solicitors, unfortunately one afternoon I was in a bad mood and took a call from the company Graham White who took the brunt of my anger and they hung up on me! after calling to demand money. So i decided to called back and got through the Roxburgh Debt Collectors after redialling 1471 - very professional i thought but again I had a ‘polite’ discussion to which they hung up on me again!!?

I then have had calls at home to which my mum told them to stop calling or the police will be involved, the home calls have now stopped but they keep calling my mobile from a MOBILE Number, again not very professional if it was a legitimate company (I’m willing to post the numbers I have had calls from if that’s required?) to which I ignore, play loud music down, sing to them etc but they keep calling me!!

After 9 months of me not paying, ignoring, being slightly abusive to them I was hoping they’d get the hint, but no they keep calling me…

Can anyone advise if im going about this the right way and also Does anyone know if they every give up calling??

If you feel the need to contact them ie: cant take the pressure from the threats, then please add in your letter a reference of law to get them to back off as they have NO legal standing to collect this [problem]med money....

The Administration of Justice Act 1970.

Section 40 of the act provides that a person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under contract, he or she:

A) harasses the other with demands for payment which by their frequency, or the manner or occasion of their making, or any accompanying threat or publicity are calculated to subject him or his family or household to alarm, distress or humiliation:

B) Falsely represent, in relation to the money claimed, that criminal proceedings lie for failure to pay it:

C) falsely represent themselves to be authorised in some official capacity to claim or enforce payment:

D) utters a document falsley represented by him to have some official character or purporting to have some official character which he knows it has not:

 

Finally you could by an Acme Thunderer (Refs Whistle ) on ebay for a couple of quid and give them a few blows when they phone, for some reason they dont like that He He

Thanks for the advice; i will continue to just ignore them which seems the best practice.

Spike - I don’t mind them calling me and not going to back down to them so I’m sure they'll get bored of being ignored or having loud music blasted down phone to them a lot sooner than i will. Was just hoping they'd get the hint by now and stop calling!?

Also i had a yet another call yesterday from them I just answered it without speaking and left it on my desk for ten mins so they could hear silence and to waste their money.............But it gets even better, i have just had a TEXT MESSAGE from Roxburge (same mobile number 07837 667077 that keeps calling) asking me to call them!! Now if that isn't a sign of a legitimate debt collecting agency I don’t know what is!!?

 

Any ways ill keep you posted if any other form of contact is recieved, kind of expecting them sending an pigeon next!!

Type 'call me back' into Google and copy and paste that number into every call me back form. The next day they will be inundated by people.

It'll take about 30 mins of your time, but it works a treat.

 

Of course, I couldn't condone such behaviour and hope that you wouldn't do such a thing.

I was working on a retail park but on my first day i parked in a disabled spot not realising! i recieved a ticket from EXCEL even though parking was free for staff so i decided to write an email to them explaining my situation to see if they would cancel it....I recieved a reply in the post saying that because I had admitted parking in the disabled spot there was no grounds to cancel it and because i hadnt supplied a postal address, (i sent an email) the fine was now £120 rather than £60 pmsl !! Having had dealings with these [problem] artists before this proved to me that it was dodgy and I will not be paying it, or contacting any of these bogus companies ever again.

 

Excell have just lost TWO court cases like this so they will not be bringing you to court....Follow all the advice on here and IGNORE THEM, IGNORE THEM, IGNORE THEM !!! Dont be intimidated by soliciters letters or baliffs letters!! Ignore them all !!!!

I am just wondering if anyone has had any experiance with the above car parking company in the past. The ticket is for exceeding the parking limit in a retail car park in Mansfield ("Code 80 offence") in November last year. I cannot clearly remember that far back so am not sure what the parking limits are at the retail park however I will go out there and investigate.

 

This is the first time that I have received a parking ticket so am not sure as to the legal requirements of their charge. Their charge letter claims to have photographic evidence to support their claim.

 

I would be grateful if anyone could summerise the best way to appeal parking tickets and if they have had any success arguing their case with Excel.

I'll post this on a couple of threads I've contributed to before to get maximum exposure for people looking for evidence of Excel being able to do nothing.

 

It's now Aug 2013 and I got my ticket at Wakefiled from Excel in Dec 2009 - I've had all the blurb, the three Excel parking letters, the Sobel letters and the Debt collector agency letters - and after all this time I've not parted with a penny. Plenty of time spent complaining to the ICO and the DVLA with FOI requests about this companies operations - so much so, I think they're still currently banned from the DVLA database.

 

Here's living proof if you need it - I got one, three years plus - and nadda from them !
