Hi,

Evri have lost another parcel of mine, please don't ask why I decided to use them again - I've been using RM only since this parcel went missing.

Sent a New Nintendo Switch Console. Insurance not purchased but correct value stated when purchasing label through Evri website. Parcel value is £245.

Sent the parcel on the 29th August 2023 and lost on the same day, sent a claim on the 14th Sept 2023,  received a response back today (03/10/2023) stating they're not paying the measly £20 compensation as item is on the "non-compensated list" - Would it still be possible to take this through to court and still win?

I've attached my LOC which I'll be sending out tomorrow via RM.

If I had my cynical hat on I'd say their "non-conpensated list" sounds like an attempt to evade compensation for items they know their less trustworthy subcontractors are most likely to pinch.

I'd be interested to know what sort of other things are on that list.

You'll need to wait for advice on the legal position, but they accepted your item for carriage after you declared what it was. It doesn't seem to me like they should be able to retrospectively refuse to accept responsibility for it, which is what they seem to have tried to do.

Note the vague wording "Common non-compensation items include".

That wording effectively allows them to include anything they want... retrospectively!

In your letter of claim, does the £244.99 Value include the delivery charge of £5.88?

Or, have they already paid you £5.88?
