      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I tried emailing DG (after I got answer phones on all the numbers) but heard nothing back. and nothing in the post either.

They seem to be the worse for draging it out. I had nationwide payup before AQ in full and MBNA payup at LBA (and that was with 21.9% contractural interest.)

ok... another lesson learned!

 

i have been telling peeps to bombard dg with emails. this is now having an adverse effect! they don't seem to be answering emails or phone calls anymore - probably switched off the phones to outgoing only!!

they are absolutely 'snowed' under with claims - at all different stages. they're not filing their aq's, and not responding to people, much further down the line to when i first joined the forum. so..... i think in retrospect, only call dg if it's necessary, email them with your breakdown and give them the 'one' call to see if they've recieved it - if they say they have, then give them the benefit of the doubt. lets give them time to catch up!!! and start paying people instead of harrassing them.

All of them have been in this position.

A good example is RBS/Natwest who suddenly out of the blue in January began paying out after 14 day lbas.

Feeling is that this was to shift backlogs.

Refunding into live accounts is much easier than a closed one too so this has to be considered.

With Solicitors of the banks they appear to be working from the first come first dealt with theory and it makes sense for them to do that since they can work within their court deadlines.Its fair to say they have probably been distracted by trying to settle the people who are calling them,realising that in many cases this will save on carrying on the litigation.

However they are aware of the hard core who they know will see things through,and my feeling is that they have been caught out in court deadlines here as they have tried to settle the simpler cases (or those who want to settle NOW ) and have learned from the mistakes of missed court deadlines.

Unlike the likes of Barclays........or worse Citi....who simply still believe theres a way out of paying at all !!!

 

Anyone who feels they have had a bad time with their claim should read a few Citi threads.........you would just not believe what they have put their claimants through and are still doing now.

i hear what you say martin... half of me wants to give them time to get on with the job.. but the other half is thinking that it's the 'big people' against the 'little person'. probably the one and only time that we'll ever get to feel some sort of empowerment over them. however, the volume of claims they have to deal with will be better dealt with, i think, if we leave them to get on with it without as many interruptions as i for one, gave them!!

Yes Netty you are right.

In the early days I remember having some good e mail contacts but after putting them up the people changed them following mass bombardments as you say.I think theres a case for aving the e mails for ufgent requests such as dpa breaches,where you would get a reply.

Its quite easy to work out a lot of the bank contacts e mail details if you know one of the addys.For example Barclays use the first name then dot second name then dot com. obviously you only need the spelling.

I do quite a bit on the debt forums and have a nice list of e mails and contact numbers directly for most of the debt collection and baliffs but I could never post them there as they would change them immediately.

Good to have them for emergencies tho !!

baby, it was my attempt at dry humour - meaning that i was so stressed by it all that the weight would drop off!! i don't really have any weight to lose - but well done you (if it was meant for you to lose it, that is!!)
