I am paying my debts back through a DMP

 

 

however I'm getting hassle from Blair, Oliver & Scott over my BoS loan.

 

 

 

 

Is there anyway I can get them to pass this back to BoS Retail Bank Collections

or something so that they don't take legal action but acknowledge the DMP?

 

 

I have been paying into the DMP for about 4 months now.

 

 

They are threatening court action now. Help. :(

Are you disputing the account or not as i was in same position with cap one solicitors. As soon as the sar went off they took it back into their own hands.

They are after two things: firstly my current account overdraft of £1600 which I am disputing because they owe me £3500 in charges which I have recently filed court proceedings on. The second one they are after is a loan which has £2000 outstanding on it.

 

They have accepted my reduced payments and so are not threatening legal action. I think I'll maintain these through my DMP with the knowledge I'll get it all back when I get my charges back anyways.

Well they are not exactly going to give you the run around. As long as you continue paying them and drag them infront of a district judge to explain their charges. you can then do what they have been doing to you.

True. I think in one of my future claims, I will be seeking damages as well because being defaulted and having Blair, Oliver and Scott chasing me has been stressful as hell. All for money I don't owe them, money they owe me.

On a more serious note, now that it's been passed to Blair, Oliver & Scott, do you think it is worth while going down the road of requesting the original credit agreement and seeing if they can provide it within the 14 days + 1 month thingy?

 

Or because I am making payments to them, I have acknowledged the debt and am too late to try this?

Yes. If they cannot come up with the original agreement then they do not have a case and you can then chase them for a full refund including any monies you have paid them.

I asked them for a section 78 in July, now not paying anything and they can do didly squat about it, and they've said as much over the phone, as you have found I'm sure thay never put anything in writing. I haven't paid them a penny since August, and since reported thm to the Information Commissioner, Trading Standards and OFT.
