I have read your post with interest, I have not come across many with large claims so close to the £5k threshold for small claims. I am about to start a claim for £4159 or £4984.85 with statutory interest - so your story has really spurred me on.

Hi Catherine,

 

Yep, go for it with confidence, you WILL get it back, typically it takes around 2 months from start to finish !!

 

Just bear in mind, if you think £5k is a lot, the UK banks reaped approx £3 BILLION in charges in 2005, so it really is a spit in the ocean !!

Mine took 4 week and 2 days from the MCOL, sent my first letter on the 6th of November with 14 days to pay up, no LBA sent so 6 + 2 days in total!

and catherine - mine took 4 months - that was from first letter asking for statements to money in the bank. a lot of people think this is a quick fix - depends on your viewpoint i guess - but i think 4 months beginning to end is about the norm.

Hi Claire,

 

I've gone back and read your first posts again and note that you did not send an LBA. Im also considering skipping this, and just giving them 14 days from letter 1 before issuing proceedings. I spoke to HSBC today who basically said they have so many of these that I will not receive any acknowledgement or response to my letters.

 

My concern is that this issue is now getting so much publicity that something I'm sure will happen soon.

 

My only worry is that the not giving a further 14 days could go against me when is comes to court?

Go ahead and send the letter asap, the sooner you send it the quicker you can start your MCOL! Give them 14 days, that includes the date on the letter and any weekends (Im guessing bank holidays too)

 

But id definately skip the LBA, some people get a response from it but not usually the full amount!

You are right to worry. If you are the one that has to go to Court you won't be able to show you have given them 28 days. You also will have given no warning that you were going to sue.

 

LBA is exactly that - a letter BEFORE action - you will be going straight to action!

I have seen template letters elsewhere, including on the BBC money programme site, that state you are giving 14 days to respond in the first letter otherwise you will take action against them with no further notice.

 

Surely as long as you stipulate in your first letter that you will be taking action after a given time scale it shouldn't matter if the timescale given is 7 days or 6 months? Or is there something stipulated somewhere that in complaints and claims of this nature, 28 days is deemed reasonable in the eyes of the law??

The notice given is what would be deemed 'reasonible' by a court, the consumer credit act 1974 for instance stipulates 28 days minimum, the last thing that you would want, is that 'IF' you ended up in court opposite that 'nice' but very shrewd HSBC lawyer and the judge agreed with 'him' when saying you acted 'unreasonibly' by 'demanding' too little time to allow then to consider your claim properly !!

 

I know it's a pain playing the waiting game, but in my opinionit's simply not worth risking it!!

Hi all!!

 

I have won my claim, signed and returned acceptance on Friday at 10am. just wondered how long it took other people to receive their money!! I didnt include a letter giving x amount of days neither did I ask for it to be put directly into my account (which is what we wanted) I rang Friday afternoon and left a message asking if they'd received the fax and also said that I would like the money to be paid directly into my account and asked how long this would take.... needless to say there was no call back!!

 

So what Im asking is how long was it for you and how many of you sent letter demanding the money with x amount of days?

 

Also those of you who didnt request a payment by cheque or payment into your account which did they end up doing?
