I have looked on thr Search function for an answer but can't find one!

 

My claim has been issued, but now it's asking:

 

Do you wish to enter Judgment by Default or by Admission? Please select one of the options below:

 

  • The defendant has not filed an admission or defence to my claim
    (Judgment by Default)

    You will need to decide, how and when you want the defendant to pay. You can ask for the Judgment to be paid by instalment or in one payment.

  • The defendant admits that all the money is owed
    (Judgment by Admission)

    If the defendant has given a new address on the form of admission to which correspondence should be sent, update the defendant's details within the following Judgment request.

Um.... I dunno!!! LOL! Please help!

Once served, MCOL gives these choices to you, but you need to wait for the statatory period of time to pass (14 days after claim deemed served) on the 15th day, if Halifax have not acknowledged your claim (this will show as Acknowledged on MCOL if they have) you can select option 1.

 

Halifax generally acknowledge within 2-4 days of claim being served via MCOL, this then gives them an additional 14 days (or 28 day total) to file a Defence.

Halifax generally pay up on the Wednesday (check your account after 9am) of the following week after acknowledging the claim, and they send you a letter asking you to contact the court to advise that you no longer want to persue your claim.
