  1. Hi all, Any help or advice gratefully received! I am helping out a friend, whose £400 laptop packed up 6 months out of warranty. PC World fobbed him off at first and told him out of warranty tough luck, when he told me what had happened I informed him of the SOGA. I went with him to store and they referred us to Cust Serv (Who I rang from the store) and they said to get an independent engineer to take a look, do a report and send it to them, if it is too expensive to repair he would get a refund. Then two days later, he gets a call saying not to bother with the engineer's report and they would refund him £229. Now, I appreciate that depreciation has to be taken in to account, but I argued that a 43% depreciation 6 months out of warranty is an insult and tried to negotiate with them, they wouldn't budge. I think maybe my friend should consider taking this to small claims court? What do you think? Any one had any similar situations?? Many Thanks, Vickki.
  2. Hi, nobody spilt a drink, they were simply mopping the floor early so they could finish earlier it seems and they decided not to put any signs up as they did so. The only reason I am considering it is because I have suffered a fair amount of pain thus far with no sign of improvement yet, plus it was through no fault of my own. With regards to suffering financially, if I need physio then I will suffer as I have a neck condition at the mo and can't afford physio for that as it is, so deffo won't be able to afford it for my knee if the GP suggest this tomorrow. I'll see what the GP says anyway. He might be able to alleviate the pain for me until it finally heals.
  3. Hi All, Wonder if anyone can help? Two weeks ago this coming Friday, I was at my local leisure centre watching a live band. I walked out of the auditorium in to the main public area by the bar to meet my friends and all of a sudden my feet went from underneath me and I landed with a hard crack on to my right knee. At I the time, I burst out laughing, with shock.. and embarrassment as everyone in the bar area had seen me. Then as my friends were helping me to my feet, a member of staff literally flew down the stairs and plonked a "slippery when wet" sign down! We were so shocked by the action of locking the gate after the horse as bolted, that someone took a photo! We then realised that there was another staff member mopping the floor very close by, it was still very wet where I had slipped over and the only signage around was the one that had been put down after my accident. (He too was caught on photo! Heavens knows why!) Within half an hour my knee was REALLY starting to hurt, I rang my husband to have a moan as I was starting to feel pretty sorry for myself and he asked if the staff had put it in the accident book, I said I hadn't even had an apology let alone it being reported. So with that in mind I made them put it in the book, there was also a child waiting behind me with a bloody nose. He had slipped over somewhere as well by all accounts. By the time I got home, it looked like I had a hard-boiled egg on top of my knee, it was swollen quite badly, within 2 days it was badly brusied. Now two weeks later it still is not right. If it even gently catches my mattress or duvet in the night the pain wakes me up. I haven't seen my GP yet as I thought it would get better, but did speak to him on the phone the other day and he said to see him if it doesn't get better, but it has been so bad tonight that I am going to see him tomorrow now. Friends say I should start a PI claim against the leisure centre. Part of me thinks that it was just "one of those things" and it's not like I have broken my kneecap or anything, but the other half thinks that they were negligent and should have not left the floor sopping wet with no signage during a busy peroid when there were many patrons. So my first question is should I make a claim? My second is, if I do make a claim, which route? These no win no fee companies that you see on daytime TV always seem dodgy to me, not sure if that is just my perception mind you! What do I have to lose exactly? Is there any outlay?? If I do decide to claim then I am not well versed in this situation, so any further advice, help etc.. gratefully received. Many Thanks, Bradders.
  4. Hi all, Just quickly, I have 3 bank a/c's with A&L, two sole a/c's, one joint a/c. Each month we transfer money to the joint one to cover the bills. I do this on the 28th and my hubby on the 1st. This month the 1st fell on a Saturday, so A&L transferred the money on the 3rd, which is the same day as the mortgage payment. I looked online on the 3rd and the a/c all looked fine. Today we get a letter charging us for paying the mortgage when there was insufficient funds?!? I call up and was told that the standing order transfer registered AFTER the mortgage DD, hence the charge. I asked for it to be refunded as when you look online it shows the transfer as the first transaction of the day and the mortgage DD as the last, how as I do not work in a bank how am I to know this little quirk in the banking system. He explains that's the way it works and tough-titties basically. I politely demanded a refund, he started spouting that the FSA has "told them to decline any refund requests" until the banks court case finishes. I corrected him and said that the FSA have not "told them to decline refunds" at all and pointed out that A&L aren't part of the OFT Test case anyway and just choose to take up the FSA's waiver. I also point out that I am not disputing a disproportionate charge, I am disputing the charge in it's entirerity as my standing order is set up in good faith to transfer the money each month and asked him how it's MY fault that I got charged... He could not answer that. I am waiting on a manager to call me, what can I say to persuade them to refund this one charge? [EDIT]
  5. Interesting as when I rang them thsi morning, they said PSCOs have the same rights as Traffic Wardens!?!?! Also, they have issued me with an FPN for an obstruction that was not obvious that I was causing. BTW, another sucker is parked in the space today! Like there is EVERY day, they must be raking in a mint on that space.
  6. They are private bays, but with no restrictions or permits required. The Red, Purple and Green bays are relating to council owned bays that are patrolled by NCP, these bays do not have this as they are not council owned.

  9. Hi, Thanks. I haven't really got the £30 to pay in the first place, so the thought of paying a higher fine doesn't appeal. But on principal as well as finances I want to appeal especially, as I feel that my FPN seems riddled with flaws and very unjust. Is ther an upper limit on what my fine to go up to? I would have thought that if I stated I good case (I have maps, photo's etc.. ) that I would just get the FPN struck off? Obviously not then!! Bradders. x
  10. Hi All, Hoping you's can help, bit complicated.... But I got given a Fixed Penalty Notice by a Police Community Support Officer yesterday. Parking is getting horrendous where I work (Central Milton Keynes.) due to Developers building on all the bleedin' car parking spaces... ANYHOO... In CMK, parking is mainly meters or permits and it is ran by NCP for the council. Yet, in two places in CMK by my work there is a small rack of parking spaces, sandwiched between two sets of private, controlled parking bays. That have no road-markings, signage, yellow lines or ANYTHING, people that get these in spaces normally, get there early and do not have to display a ticket or permit of any kind to park there. So yesterday, I was as pleased-as-punch to get one of these spaces, having spent 20 mins of my lunchbreak trying to find a somewhere. But upon my return, I had a FPN from a PCSO saying that I was causing an "Unnecessary Obstruction" and that was all it said besides the fact that I have a £30 fine. The cars next to me, were not ticketed and I could not see what I was obstructing. I double-checked and there were still no signs or road markings! I rang the officer today and was told I was obstructing "a path leading from a fire exit" and that the business who's fire exit it was reported my car as it was "an ongoing issue for them".. Yet there were no signs saying "no parking" and none to indicate I was near any fire exit, let alone a "path that leads to one".. I was also told that CMK was a restricted area and that you'd get ticketed for parking anywhere other than a marked bay, which, yes, is true, but none of these bays were marked, yet only I was ticketed, and the parking in marked bays rule as far as I am aware applied to bays only under NCP's jurisdiction, otherwise, private and free bays would get tickets too. Plus, if this is another reason for my ticket, it wasn't even stated on my FPN. I was ALSO told that where I parked was a footpath / pavement, I'll agree that the paving was grey-slabs and not grey block-paving like the rest, but both were on the same smooth level, there was no kerb, steps or road markings to show it was a pathway. Again, my FPN did not state I was parked on a footpath / pavement either. One more thing, it says I was parked on Midsummer Boulevard, however I was not, I was parked on a small back road which links Midsummer Boulevard with an exact parallel road called Silbury Boulevard, the roads doesn't appear to have a name, but being picky, I wasn't actually parked on Midsummer Bouelvard was I? So, I have started typing my letter of appeal, wondering if I stand a chance, what I can add to improve my chances and if there is a risk of a bigger fine at all?? Thanks in advance, Bradders. xx
  11. Hi all, Sorry that this is a long one, but I've been in tears and really need some help. I need advice, it's not about bank charges per se but about a letter I am going to compose for compensation and I am wondering how much I should ask for and if I would get it. I have a mortgage with Nationwide, it's a fixed rate at £845 a month. My fixed rate was coming to an end and whilst I am waiting for my new fixed rate mortgage with Abbey to complete I rang up Nationwide as I am not massively au fait when it comes to mortgages and wanted to know what date my mortgage payments would go up from, as I have a separate bills a/c so I needed to know how much money to pay in should I happen to be switching to the variable rate on 1st August. The Nationwide call centre advisor told me that 1st of August would be my last DD payment to them at the FIXED rate and that if my Abbey mortgage completed in say the 2nd week of August, then I would owe Nationwide the new variable rate on a pro-rata basis, IE: they's just take for the two weeks at the higher rate. So, I go and pay my usual amount in to my bills a/c, to cover all of my DD's including the usual mortgage amount, then lo-and-behold instead of taking £845 Nationwide take £1035! which makes me overdrawn, which then incurrs me £50 in charges; £25 for paying an item with insufficient funds and £25 for being overdrawn. I rang up Nationwide upset and in disgust and they say that they will listen to the phone call where I was "alledgedly mis-informed" and get back to me, they called me a few hours later and said they they listened to the recording of the phone call and I WAS mis-informed and that if I send them a bank statement they will refund me the £50 bank charges. But that doesn't help me one iota at this present moment, as the extra money they took swallowed £100+ for the 3 remaining bills due tomorrow. So I had to find that money and transfer it to my bills a/c... Plus an extra £50 to make up a shortfall to incurr further charges, so I am the best part of £350 short this month now. I have been in tears, it may seem trivial, but I have a big 30th b'day party next week, I have been looking forward to it for months, I have people travelling from as far Liverpool and Russia to be here, but now have no money to pay for it, although I have never done it before I am going to have to withdraw a cash advance from a credit card now, this whole debarcle has left me so skint and incredibly upset, my husband is livid, if we had known that Nationwide were taking more money we would have budgeted for it. I spoke to the FSA and asked if NW had broken any banking codes and if I could claim any compensation, the FSA said that they haven't exactly broken any codes, but they have a duty of care and they have to treat customers in a fair and just manner. But that I am entitled to lodge a formal complaint, separate from claiming my bank charges back and they gave me timescales of when NW have to respond or I can refer my complaint to the Ombudsman. But I don't know how much compensation to ask for, being seriously out of pocket is one thing, but the distress, worry and tears they have caused is another, they've ruined my party plans and will incurr me intersest on my credit card as I have no other place to find that money by next week.. So what do I ask for and do I have a hope in hell of receiving anything from them? Your advice is gratefully received. Bradders. xx

Well blimey, this has been a toughie, I have been helping my hubby claim against LTSB following a relatively quick success when I took Halifax to court last year, they submitted a defence then just paid up... LTSB on the other hand have been swines, as well most of you will know! We starting with the SAR in January and the court date was next Fri, so it has taken a good 6 months. Last week hubby submitted a good bundle to the court, hearing letter also specified that BOTH parties must provide each other with full copies of their own bundles as well as to the court, so we hand delivered a copy of bundle to local LTSB branch and aksed them to sign for it, then included that signed "receipt" with bundle that went to the judge. Deadline for submitting bundles passed on Friday and LTSB had sent my hubby nothing, so he faxed them a letter to say that they had missed deadline and that he would be informing the judge and that their non-compliance would strengthen ourt case.. Then lo-and-behold... They pay up in full less than 48 hours... They EVEN paid the £5 service charges that hubby accidentally requested back, which he paid each month for having a Gold a/c, he didn't realise it was a legit charge at start of claim and planned to submit an amended charges list, not including these service fees when at court next week. Which means that LTSB didn't even bother checking what we were claiming for!! Oh well, their loss and our gain. So, keep your chins up peeps, stick to your deadlines and make sure they know you are serious, I really think that by sending LTSB the bundle and fax about non-compliance sped things along. Cheers!

  15. Hi all, My hubby has taken Lloyds to court for his charges and the swines are seeing it through and we have a court date of the 22nd June. We were going to do the Bundle in next couple of days, but having been on here, he's realised that we have claimed for charges related to him have services on his a/c too... He didn't realise that we couldn't claim for that as we applied for the same type of service charges as well as bounced DD and chq charges with Halifax last year and they paid up in full before the court date. But on here it says you CAN'T claim back service charges. If we can't claim for these then it reduces our claim amount by a fair bit, but we don't know what to do now with the court date looming and the bundle needing to be submitted ASAP. Shall we plead ignorance on the day it goes to court or change the claim amount some how? Please help we are running out of time. Many thanks in advance. Bradders. x

Hi All, Having successfully taken Halifax to court I am now embarking on A&L, I first of all tried to get to view my statements on-line (Only have 2.5 years worth.) but they said that they cannot do that, but if I want statements I can have them sent out at £5 a statement!!!!!! So instead I said that I would request is as a Subject Access Request instead for £10, they said fine. (Obviously thought they could scare me off with the £5 statements.) I sent the S.A.R - (Subject Access Request) letter a week ago, it was signed for next day and in the letter I said to take the statatory £10 direct from my a/c. Money still not been taken, so I call them today and ask what is happening, they said they haven't had my letter (They have, it's been signed for.) and that when they do finally get my letter that they will send me a loads of forms out to fill in for my statement request!! And to send a £10 CHEQUE back with forms, they won't take from my a/c they say. I know that if I am going down the £5 a statement route that they say you have to fill out various forms, but surely my letter is enough for my request.... Just smacks to me of delaying tactics. I rang Complaints Management in Bootle and they said they would email the relevant department and ask them to look at my request today, but they may want me to fill out further forms with may take 7-10 days..... Arrrrrrrgh! What can I do? I don't want this dragging out. I'm going round in circles. Bradders. x PS: Hubby is taking Lloyds to court tonight!
  20. I did my two Halifax current a/c's as one claim... I only paid one £10 for the S.A.R for them too, all my correspondence referred to both a/c's as did my MCOL claim.... They paid in full for both on Friday in to one of my a/c's.

  22. Well, we treated ourselves yesterday, bought some nice things for the house and went out for a lovely meal. The rest will be spent on things worthwhile... I was grinning like a Cheshire Cat all day yesterday! Hubby will send SAR to Lloyds next week, will be interesting!
