    • Yes, now its just about getting the WS / Court bundle finalised to send to the court / Evri. I've attached the most recent version of the WS / Court bundle to save having to scroll back up to the previous post (#204) where it was also shared. If you, @BankFodder or anyone else has any feedback on this, i'd be grateful for your thoughts. In my previous post #204, i'd also attached an invoice from Packlink which shows that I was charged by Packlink for these services: "drop-off at Her mes - Next day delivery" and "Proof of Delivery". It also has the payer's address and there are "Origin" and "Destination" fields which have the postcode of the sender [origin] and the recipient [destination] - I have redacted personal details in the attached invoice.  I am already including this in my evidence bundle (without the redaction) but wanted to share this redacted version so that other people can consider this as example in their bundle of Packlink and Evri's contract being instigated by the sender of the parcel who has paid for the service, and further shows that there is information in the invoice to identify that a third party beneficiary (the sender / recipient) is involved in this transaction. I have also attached this redacted invoice in this post to save having to scroll back up.     • Does anyone know if I would be allowed to record conversations with health professionals for my own use on my phone without them knowing. I know that we are allowed to record phone calls. I do record some of my phone calls for my own use due to my disability and if anything is said then I am covered. I would only record audio in private area's of myself and the professional dealing with me. I know I could not get and other persons audio in it and I don't intend to. my only other option is to buy a body cam but I am not sure the rules regarding this.I never thought i would have to but things are getting worse Thanks for any guidance

    • Ok thanks for that, well spotted and all duly noted. Yes they did eventually submit those docs to me after a second letter advising them I was contacting the ICO to make a formal complaint for failing to comply with an earlier SAR that they brushed off as an "administrative error" or something. When I sent the letter telling them I was in contact with the information commissioner to lodge the complaint, the original PCN etc quickly followed along with their excuse!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i have reading and writing difficulty so pleas don't judge

 

I'm being chased for housing benefit overpayment about £3500

 

at the same time i was on family tax credit and have agreed to pay that back in instalments.

 

i have told the council I'm paying that money back

i have not had the money and they need to recalculate the figures.

 

they have said it won't do that and i must pay the full amount back

 

is this right?

how can they add money to an account i haven't had or at least am paying back?

 

i would be very great full for any advice

its mendip county council.

they sent a breakdown of my income including weorking tax credit.

aparently i erned to much money (a couple of hundred pounds)

not contacted a polititian.

Im working full time but at the time was self employed and just started an employed posission.

the point im trying to make is that the figure is incorect as it includes WFTC as part of my income

if that is taken off i would probably ow them nothing

i understand it was money i was paid at the time but i have paid it back so how can it still be added to what they are asking for now.

Can you prove that you've paid this back?

 

Do you have bank statements or receipts to show that they have been repaid?

Did you get paid the tax credits at the time?

I'm not saying it's right, I'm telling you what the law is.

 

If you declared the tax credits, why have you been overpaid?

 

i did get tax credits but according to them i earned more than allowed. (only by a few hundred quid. thats what annoys me) i was in transition from self-employed to employed so did not know what i was going to earn.

can you tell me what the law is ? according to the housing benefit department its regulation no mention of law. if it is law I'm sure they would say it is. now i have submitted an appeal they are really pushing me to agree a payment plan and i find that very suspicious.

Which local authority (Council) is this?

 

What letters have they sent you, have they explained how this overpayment has come about?

 

You CAN get your local politicians to look at this also.

 

What other income do you have coming in?

 

my local politician is a staunch conservative who regularly votes against workers and human rights

had a reply after my appeal

i will send the full content when i get home.

 

basically they are saying i cannot appeal because its law and sent me a DWP document stating regulation 23 of the housing benefit regulations 2006.

HB/CTB circular A30/2004 overpaid tax credits

38 if an overpayment of tax credits has occurred during a period i which HB/CTB was also payable, and the overpayment of tax credits is subsequently recovered, there is no provision in regulations to reassess the HB/CTB awarded for that period.

i have looked at regulation 32 and it dose not mention anything about overpayments

Regulation 32 Calculation of average weekly income from tax credits

6 March 2006

 

 

 

(1)

This regulation applies where a claimant receives a tax credit.

 

(2)

Where this regulation applies, the period over which a tax credit is to be taken into account shall be the period set out in paragraph (3).

 

(3)

Where the instalment in respect of which payment of a tax credit is made is—

 

(a)

a daily instalment, the period is 1 day, being the day in respect of which the instalment is paid;

 

(b)

a weekly instalment, the period is 7 days, ending on the day on which the instalment is due to be paid;

 

©

a two weekly instalment, the period is 14 days, commencing 6 days before the day on which the instalment is due to be paid;

 

(d)

a four weekly instalment, the period is 28 days, ending on the day on which the instalment is due to be paid.

 

(4)

For the purposes of this regulation “tax credit’ means child tax credit or working tax credit.

local mp is not an option staunch conservative who regularly votes against human and workers rights. in the news for telling a student to f off back to scotland

 

have councillors got any say ?

 

according to them i don't have a claim as its law (not sure about that)

have asked them to point out the law that states wftc can not be deducted after it has been paid back. from what i have recived its a circular taged on to the bottom of regulation 32. how dose that make it law ?

actualy the crux of the matter is that i have not had the money ! its unfair unjust and probably illegal. they only target people who are not in a position to defend themselve. i was overpaid by a couple of hundred and they expect me to pay back 5k do you think that is fair ????

the system is intended to support people in need and at the time i was in need. but the LA are now manipulating the system making up rules and lying to raise revenue.

i disagree that what they are doing is legal. i know for a fact that if a judge says you owe money you owe money. but if you have paid the money back how can you still ow it and have it added to another debt ?

i cant afford professional help or i defiantly would. believe me its not about the money its about injustice and people just accepting what they say. there is no difference between LA and cabot. yet people fight cabot and not LA and DFWP
