    • In both versions the three references to "your clients" near the end need to be changed to "you" or "your" as Alliance are not using solicitors, they have sent the LoC themselves. Personally I'd change "Dear ALLIANCE PARKING Litigation Dept" to "Dear Kev".  It would show you'd done your homework, looked up the company, and seen it's a pathetic one-man band rather than having any departments.  The PPCs love to pretend they have some official power and so you should be scared of them - showing you've sussed their sordid games and you're confident about fighting them undermines all this.  In fact that's the whole point of a snotty letter - to show you'd be big trouble for them if they did do court so better to drop you like a hot potato and go and pursue mugs who just give in instead. In the very, very, very, very unlikely case of Kev doing court, it'd be better that he didn't know in advance all the legal arguments you'd be using, so I'd heavily reduce the number of cards being played.

Shall we raise the related VAT issue with HMRC, or perhaps the custodians of the unicorn grain silos? Apart from the serious GDPR breach you’ve made with the DVLA and your complete failure in identifying the driver, we’re dumbfounded that the PCN is still not compliant with the PoFA (2012 Schedule 4 Under Section 9.2.f) even after 12 years of pathetic trial and error. We also doubt a judge would be very impressed at your bone idleness and lack of due diligence regarding parking periods. Especially with no consideration of section 13 in your own trade association's code of practice and the topological nature of the Cornish landscape versus a traditional multi-storey. And don’t even get us started on the invisible signage during the ultra busy bank holiday carnage, that is otherwise known as the random parking chaos in the several unmarked, unmanaged over-spill fields, or indeed the tedious “frustration of contract” attempting to get a data connection to Justpark.  We suggest your clients drop this extreme foolishness or get an absolute hammering in court. We are more than ready to raise the above issues and more, with a fair minded judge, who will most likely laugh your clients out in less time than it takes to capture a couple of useless ANPR photos. If you insist on continuing this stupid, money grabbing quest, after having all of the above pointed out, we will of course show this letter to the Judge and request “an unreasonable costs order” under CPR 27.14.2.g and put it toward future taxis to Harlyn Bay instead.  We all look forward to your clients' deafening silence. Is it worth defending? Lowell brought these debts for 10 p in the pound , years ago, because they are flawed. Think about it! if it was such an easy win, Capital one could have taken it to court and crushed him.  It could be an invalid agreement, default notice, or many other things. In a nutshell , yes, and we can help you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Used by an Englishman/woman it's only effect is to provoke giggling, sniggering, pointing and nudging between fellow Scots. No one else is in on the joke so the Englishman/woman is left standing in the middle of the pub looking foolish. (That would be like this mornings form playing cricket then!)...........LOL

I don't care if it's off topic, it's getting near Christmas and it's good fun!

 

Other than the Scots would probably have referred to themselves as Sweaty Hose, who's to say it's Cockney rhyming slang!.........could have been a Scot that chipped in that particular bit of prose.

 

How Scot's are you really if you let out the secret of a real Sassenach, that's a closely guarded national treasure.........just as well this is a CB thread, hopefully there will be no English folk peeking in and we have gotton away with it.

 

Now, truth be known, I'm actually Chinese by birth so the term Sassenach couldn't possibly be levelled at me albeit I was brough up just north of glasgow for 22 years and have lived in Kent for the last 18 years so very lowerlanderish! but only by circumstance........LOL, I reserve the birthright of dodging that particular slur on my character, besides Scotlands about to thrash the Aussies at Murrayfield on Saturday and they need all the support they can get regardless of high or low lands, and hopefully another scalp for the boys.

Could I just offer a word of caution regarding advice by PM which is discouraged on this site for a number of reasons.

 

1. The success of this forum is due in large part to sharing information in the public forum.

How did it go today guys, I'm really sorry I couldn't make it, I have had my kids to look after since Tuesday when I had to rush my wife into hospital (and I do mean rush) nothing serious but she was in terrible pain.

 

R1, mate, stick your letter up here, even if the tossers read they cant do anything and will see that your part of a group that is actually doing something about them.

Hey Bookworm..........you imagine Bob's material was his own? Damn, I only borrowed his stupid book to fill in the last few chapters! It was going to be titled "Bob, my Scottish roots, written with my mate Dread who's my inspiration and abiding companion" (I thought the title needed to be shortened but......we all know Bob!) then quite unexpectadly the book was stolen from me. Imagine the press reaction, well obviously they didn't want to implicate me so they kindly left me out of the whole sordid affair thereby maintaining my anonymity to help my other mates write their books like "Bono, did they call me that at school or did I make it up". Then good old Elton "Did they call me that at school or did I make it up?.....don't be stupid it was the first attempt at Bernie naming something and it stuck". These artists really ought to get their titles sorted out! Talking of titles, "Beyonce" whats going on there then, if she wants a short name, take a leaf out of my mate Princes book and do it properly, squiggle, that was my idea as well, as soon as he started using it no one recognised him, all through the 90's and to date, we have not seen hm so it worked...........Damn I'm good........Strangely though, I feel the need to lie down, can't imagine why.

"Accosted" is the right word. Although to be fair, the TV guy was put up to it by someone, can't quite remember who... All I know is I turned round, and they were pointing at me, saying: "That's the woman you want to speak to..." :shock:

Caro and Bookworm, Hijack away, I'm loving it and as I have nothing more to report than having written to the FOC with my complaint on CB's obstructive behaviour (filled in the official complaint form) and sent it off on Friday with all the letters I have written to them. Hopefully they will do something although, like you, I doubt it however I reckon it's worth a try.

 

Considering I'm only about half an hour away from the protest I was pretty hacked off that I couldn't make it, as for my wife, she recovering, almost back to normal. I'm glad you all had such a good time, now I guess I do owe you two a drink.......a painful offer I'm compelled to make, painful?.....short arms and long pockets ! LOL. I'm off to read the reports on it now.

However, in this particular circumstance, Royal Mail has discharged its responsibilities by delivering and returning your letter (I note that the item was left in its opened state when returned by the bank). what a bummer, as usual an organisation set up to protect members of the public doing a F*****G great body swerve. Did they say who you should go to about mail being tampered with?..................stupid question really, they would probably say the Police, who would in turn say, "civil matter mate, sorry".

 

What the hell do we all pay income tax, VAT, Road tax, petrol tax and every other damned stealth tax, struggle like buggery to build up businesses, educate our children and turn them into decent citizens when the chav's on the street corners can't be moved on and stupid ass quango bureaucrats simply shuffle paper, go for 3 hour lunches, take their fat salaries and refuse to do anything for the people they are supposed to represent!........Spitting mad doesn't quite do my feelings justice.

And there's a coincidence, letter arrived this morning from FOS, usual bumph about passing on the complaint to a caseworker blah de blah. No Christmas card, not even a Merry Christmas! I suppose their too politically correct in case It'll offend my faith!

 

I did, however, get another obstuctive letter to the last letter I wrote to CB which now I can't find!...........did a monster shredathon last week, hope it didn't get mixed up with that somehow.

I'm still spitting mad (10 minutes later...LOL). They are complete tossers, prosecution is usually discretionary and it's not the effing Post Office they should be doing something about it's the sodding Bank. So we all now receive summonses, tax demands, parking tickets for Pete's sake!, by registered mail, open it, don't like the contents so simply drop it back in the mail to be returned to the sender. I bet Postcomm would be fast enough to prosecute one of us for doing it, but not a bank........Noooooooooo, they're to honest, must have been a mistake! Feck, Feck, Feck!

Been screwed by banks all my life, it's payback time!!!!
