Hello

 

I am due to apply for the British Citizenship.

 

I was caught using Freedom pass by TFl. Tfl did not prosecute me, my case was settled out of court.

 

Question 1: does that amount to an "out of court disposal" because I am soon applying for the British Citizenship and I need to know whether I need to wait 3 years since the incident. If it was "an out of court disposal" I have to wait when 3 years will pass in order for my application to go through successfully.

 

Question 2: does Tfl inform the Police of this? Freedom pass is a serious offence ;( because the Home Office will carry out checks with the Police as well.

 

In the naturalisation application it is mentioned: "A non-custodial offence or other out of court disposal that is recorded on a person’s criminal record" ... and "Application will normally be refused if the conviction occurred in the last 3 years."

 

No other offences apart from this incident.

In my first question i am asking that someone with experience and knowledge answers

what does actually count as "out of court disposal" .

it means it was settled out of court

so is not recorded.

Out of court disposal means that court proceedings were not initiated or withdrawn before reaching court.

In other words they didn't take you all the way to sentence and therefore this matter will not be known to anyone apart from you and TfL which acts as a private entity when taking people to court.

In fact in each and every one of their cases the cps is not involved because they follow the private prosecution route.

You will have no problem with your citizenship application, believe me.

BTW DX is probably the most clued up on court proceedings, so you should believe him too.

So if I have had an out of court disposal I will need to wait 3 years when i can apply. :( ???!!!

Hello forum members!

 

I have prepared all the documents for the naturalisation application, however, when reading Naturalisations Guide AN on page 4 it says: "information oyou give may be disclosed to government departments, other agencies, local authorities and the police..."

 

My concern - when i was caught using the freedom pass (as mentioned above here), the local authority was involved as the freedom pass was sent back to the local authority. even in the interview with TFL they informed me that they had to let the Local Authority know what has happened. Although, my case as mentioned above, was an out of court settlement.

 

I am worried when i apply for the naturalisation, that the Local Authority may disclose this information. I have moved now and do not live in the same area, but I doubt it makes any difference.

 

Please advise.
