      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi ..Just been reading this thread...and it's almost a mirror image to my nightmare.

The same players as well ..LOMBARD ...THEN IDEM ..THEN ARDEN CREDIT....

.Who are really turning up the gas on me constantly reviewing my payments to them every few months and constantly pressurizing me .

 

I had the original loan with Lombard taken out september 2000. for

£13,300 &

PPI upfront payment of £2431.87

.plus total charge for credit £4081.33

total amount to be paid = £19813.20.

Via 60 x monthly payments of £330.22 @ 9.90% APR.

 

In 2001 November.

I had a nervous breakdown and used the PPI to pay the load for a year.

After which time the cover expired.

 

As I have been disabled with mental health issues these past eleven or so years

I have just been paying reduced payments to the various people Lombard seem to flog my debt too.

 

They (Arden Credit ) are always asking me for more money (which I have been doing but have now reached my maximum of £120 per month) as I am on DLA .

They know I have mental health issues, but when I tell them I cannot afford any increase to my monthly payments they send out a income & expenditure form .

(even though I e mailed them one two weeks ago.after seeking help from the National debt helpline).

 

What annoys me is I never ever fail to respond to them in any letters,

but when I e mail my responses they say they have no record of the e mails until I challenge them

...then they say

..oh yes here it is.

..its making my health worse and

I need to know if there is anything I can do to get the people off my back ..

..how much power do these people actually have

..given that this debt was taken out in 2001 ,

 

And I have never ever missed a (reduced ) payment to whoever was handling the loan.

 

And do I have any thing to go on with regard to this PPI Payment which I originally paid out for......

STOP talking to fleecing DCA's on the phone!

 

they have no legal powers and are not bailiffs..

 

time to DROP the payment to £1PCM

 

fire them off a CCA requst

to LEGALLY findout if they have the necessary paperwork to demand ANYTHING from you. [which i doubt!]

 

next is to SAR the originsl creditor.

to findout IF [i doubt] your payments have ACTUALLY gone off the debt!

 

looks like a cash cow account to me.

 

lastly check your cra file [see below]

as i doubt this shows now.

Thank you for your quick response DX.

 

I have had regular statements from the "various companies" who seem to have been sold my loan over the past eleven years or so.

 

And the outstanding amount on them is reducing ! .

 

Or appears to be.

 

I also asked for the interest to be frozen on the account many years ago..but not sure how I find out if it has actually been frozen ?.

 

I am afraid that owing to my Health issues over the years,

I have found it less stressfull to pay these people ,

than to tackle them head on..

.but I am thinking now that I might be getting "cash cowed " as you say. .

 

As I have very little understanding of the debt "industry". I am at a loss to know where to start.

 

First of all I would like to know what all the "jargon " used means, for example ..DCA ..CRA FILE..CCA ..SAR.

 

I need a basic understanding of all this if I am to stand any chance of tackling them.

 

With regard to the Arden income and expenditure form they have sent me..

..can I refuse to fill it in, as they want to know the value of my property etc.

 

...The loan was an unsecured loan.

..so they should not be asking me stuff like this should they ??..

 

I have sent them an income and expenditure form via e mail, yet they pretend they have not had stuff whenever I use the e mail route......

you might well be getting 'statements'

 

but i bet thats from the fleecing DCA'S [ Debt Collection Agencys]

 

not from the ORIGINAL CREDITOR the OC

 

DCA's by debts for PENNIES

 

then fleece people by sending scary letters.

 

they have no LEGAL POWERS to do ANYTHING

unless...

 

they OWN THE DEBT [ check your CRA file - see below]

and the hold a copy of you CCA [ consumer credit agreement - the paperwork you SIGNED wnen you took the credit out]

 

if you hold on the black underlined SAR

that will tell you what it means and does.

 

and you are correct

 

NO-ONE!! bar a JUDGE has the right o see ANY of YOUR personal financial details.

Thanks for getting back to me.

 

I actually get statements from Lombard every six months.

 

But from March last year the six monthly statements are now coming from someone called IDEM SERVICING.

 

Whose adress is St Catherines Court Solihull West midlands.

 

Which funnily enough is the same address as Arden Credit Management.

 

Any idea whats going on there ???

 

 

Taking things a bit further. If they do not have (Arden Credit ) any ownership of the debt, and they don't have a copy of the CCA (which I stil have a copy of ). What can I legally do ?.

idem & arden are the same outfit

 

and lombard loans were latterly admined by RBS , who are also freinds with these lot

 

can you get your cra file

if they dont have it, then they poss get no more money.

yes its only for varification

 

quite safe

 

one of the best things to do

 

actually shows you what your debts really are and if you have any 'dodgy' ones

 

certainly if a debt you are paying does not show

 

you should do some serious investigation into why.

Just checked my credit rating / report.

 

And the loan of which I speak of is not showing up at all.

 

Only another smaller loan is showing up under Idem securities and is all marked up in red for every month as late payments .

 

Is this because I am only paying them £25.00 a month and not the original amount agreed on when the loan was first taken out??.

 

What do you think about the larger loan not showing up under anyone at all ??????

No more debt ,

just the two which were both taken out with Lombard originally .

 

One in 1998.and the

 

big loan in 2001.

 

This was at a time when I had a very highly paid job and no Health issues.

then get an sar off to lombard.

 

then we will look at the PPI reclaim

I am getting confused now. My concentration is not good owing to my health issues. You mentioned it being time for a CCA. Now you mention SAR .

I am really at sea with all this , as I do not understand it all.

 

In what order do I CCA and SAR ?. And who do I send this to . Arden are chasing the money, but Idem supply the statements ???.

Not sure what you mean about the loans being linked. Please excuse my ignorance...I need everything explaining to me ....

 

What should I do about this income expenditure form they have sent me...????.

no bother eddy

 

you appear to have two debts owned by idem

 

one you are paying [but does not show on your CRA file]

 

one you are not [but does show on your cra file].

 

 

for ANYONE to demand or accept money from you

they MUST hold a copy of your agreement for the said loan

 

this is called a Consumer Credit Agreement [ the thing you signed to get the money]

 

you now need to send IDEM this:

they have 12+2 days to return the CCA,

if they dont

Just to clarify the situation .

 

I have two loans of which I am paying off reduced amounts every month.

 

The statements I get for both these loans are from Idem.

 

The larger loan is not appearing on my CRA , but the smaller one is.

 

I am also in the process of checking with experian to see if the CRA shows anything different to Noddles CRA.

 

Will try and get my head around this a bit more today...I am full of flu at present , which is not helping either....

Should I ask for the CCA on both accounts "owned by idem" .

 

And if so do I quote the account numbers on the statements from idem OR THE ORIGINAL ACCOUNT NUMBERS FROM LOMBARD....

 

For the CCA is the fee per request or per account CCA request..

 

..and is this letter ready to just cut and paste. (is all the info and fees mentioned up to date ).

Hi everyone.

 

I have only recently joined this site, and have no real understanding of the seemingly complex rules and regs regarding loans and debt etc.

 

I have recently looked at my CRA via Noddle.

 

And of the two defaulted loans I have had since 1998 and 2000.

(of which I am paying off reduced amounts each month since becoming disabled.).

 

Only one is showing.

 

both loans and balances are now being statemented via Idem (previously Lombard who I took loans out with ).

 

Any Ideas on this..

.and is there some sort of ruling that loans that have run in default over six years should not appear on CRA reports regardless of them being paid off or not...

 

I am very confused as to what is correct or incorrect.....

to someone who pays nothing after default and ends up with a clean file after 6 years.

 

 

so you need to write to the CRA and ask why the 2nd defaulted account is still showing

 

noddle have a box you can hit on the debt and question it.

 

as for the two debts....

 

have you looked at CCA'ing idem?

 

and have you got all the statements to see if you have PPI?PENALTY charges you can reclaim?

 

a bit more history too like what the dent id for and dates might help too.

 

if idem dont OWN the debts, then you need to question WHY you are paying them not the OC

as indem are famous for hidden charges.

you need to send two CCA requests to whomever you are paying..

 

one for each account and with two BLANK £1 PO's

 

use the original account numbers.

 

as for the SAR

 

one £10 PO needed

 

and post that along with the SAR request to the ORIGINAL creditor.
