    • I have had a pre "warning" from TM Legal regarding 2 old debts stating they are going to send a claim form in email. I was sent a PAP form which i responded to on both but like a melt i sent their PAP pack back to them in my request for CCA etc using the CAG response form. I have not to my knowledge received a response for either. my question is, will sending their pack back cause me issues in the future? can I request they send this back to me?

    • We initially raised a complaint with the finance company who told us that as its over 6 months the consumer rights act won’t apply and we would need to provide evidence of the problem being there at purchase. As we have only just got the report from Mercedes we haven’t been able to submit this within their 14 day timeframe. Is this not the case then? Thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I'm having problems with go debt,

 

back in 04 my now ex husband took a yes car fianance out,

during our divorce in 07 it was made clear that the money owing was his responsibility.

 

End of last year I had a letter from go debt, saying I owe money in the region of 7,500.

 

The letter is in my new married name nee my ex surname.

 

My husband returned the letter,

 

have now heard that it will go to their solicitors to be put for a ccj and then the bailiffs will come, and take things for public auction.

 

If I don't contact them with a decent offer, any advice please

If you havent made any writen acknowledgement to the debt or made a payment then its SB.

 

Since it was yes car finance, its very unlikely any paperwork exists either. I'll go with SB if what you said here is accurate.

Then youll need to check. Whose name is the finance in? Not whose name was the letter or they alledge the finance is in. WHose name was on the original forms.

please read the letter properly it doesn't say WILL anywhere.

 

 

never trust anything go debt do

say

or

send you

they are VERY untrustworthy.

 

 

have you checked your credit file

If its a welcome debt then no paperwork will exist and there will be other errors on their part. They got rid of most of it years ago after colossal failures which caused them to be shut down.

 

Time to do your homework.

bet it was not a voluntary termination either

and welcome spoofed you into Voluntary Surrender

and repo fees

and pay the rest of the loan for the car.

 

 

and you'll have £1000's in reclaimable fees and GAP/PPI etc

all can be reclaimed.

 

 

its usual for these welcome loans go debt have

 

 

pers i'd be ignoring them

or get an SAR off to welcome.

 

 

bottom line is you got had

they'll be nothing you owe, more like they owe you.

No. Youll do your homework and claim regardless if you hear from them or not. Dont you want all that money you can reclaim?
