      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Bought LCD for £350 from Homebase/Argos.

It is not working anymore.

 

 

Now, i believe i am covered by 6yrs under SOGAct:?:.

 

 

Trouble is i do not have receipt duh ! -it is somewhere because i never throw away but you know when you try to find something .

.....and i don't know which credit card i paid with :|.

 

 

Now i recall discussing with work colleague my new tv purchase around New year

-i'm sure delivery was around xmas

- but that is posted 10th Jan 2009 -so that sort of fits - but is a bit askew. But puts it at just over 5yrs

 

I emailed Homebase told them i do not have order number .......they replied

" please give us order number so we can investigate" :mad2:

 

Later they emailed "we have tried to locate your order under the details provided but have not been able to do so.

Can you confirm if the address of is the full delivery address?

If so can you provide your proof of purchase and we can look into this further."

lord if i had proof of purchase........:mad2:

 

Now if you belive some peeps i don't even need proof .

Just pop down to argos and get a new replacement of similar value :?:

 

And lets say that is nonsense then does my Credit Card protect me ?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

after that long you cannot demand a refund.

and anyway outside of 14days it upto the retailer to decide repair/refund/replace

 

most prob a repair or eqiv monetary refund but that wont be much after 5yrs 3mts.

 

IMHO you are not on a winner sadly here.

 

it could be argued the 5 yrs + ownership is a 'reasonable' time for the product to last

under SOGA

As DX has stated, SOGA is your friend for real disputes.

 

You cannot just keep demanding new equipment if it fails within 6 years. Your TV cost £350, if you divide that by 6 years, they would, at a push be liable for about £58. This would cost you so, so much more to persue.

I used to do LCD TV / Monitor repairs. 6 years is how long they usually last before developing a fault.

 

I think you're pushing it a bit here. You won't be able to get a £350 tv for replacement. Certainly without proof of purchase, or even an order number.

 

If the fault is that the screen stays black, power light comes on as normal, or the screen randomly goes blank, then it's a simple fix if you have basic soldering skills. Around 90% of the LCD tv's i've fixed have had the same issue with either blown capacitors or blown transformer. Around £10-£15 in parts max.

 

Edit: Looked up your TV model, looks like the capacitors they use aren't the best. I'd put money on it that that is the issue.

Thanks -yeh not demanding replacement , just seeing what options are.I think best case scenario i could hope for is a repair (or a self repair )

JoeyJoeC - when i switch tv on , the green power button then flashes red -after that nothing at all

might seem too obvious, but have you tried new batteries in the remote.

reason why ask, is that mine started to go on then off (red) after doing the on on the remote. new batteries in the remote solved the issue. (or cld try the manual on/off on the unit)

Thxs This is with manual on /off. The remote stopped working ages ago.I did get remote going again by opening it( using a hammer and chisel :shock::shockl - seriously it is the only way to open it!!!!!!) up a giving circuits a clean - but it was short lived.
